Notwithstanding any other Act or law, no person who obtains information or documentation under this Act shall be required, in connection with any legal proceedings, other than proceedings relating to the administration or enforcement of this Act or criminal proceedings under this Act or any other Act of Parliament, to give evidence relating to any information or documentation that is privileged under this Act or to produce any statement, document, writing or portion thereof containing any of that information or documentation.

(Return tabled) Question No. 443 Ms. Anne Minh-Thu Quach: With regard to the dismantling or transformation of the cargo ship Kathryn Spirit by the company Groupe Saint-Pierre: (a) what federal statutes and regulations apply to the transformation of the ship; (b) which departments are responsible for enforcing the statutes and regulations in this type of situation; (c) has Environment Canada assessed the environmental risks of the operation; (d) has Environment Canada attended any meetings with Groupe St-Pierre and other departments or levels of government; (e) what was the outcome of those meetings; (f) what are Environment Canada’s evaluation criteria for this type of operation; (g) what were the results of the environmental assessment; (h) what measures has Environment Canada or any other federal department taken to ensure that there is no environmental accident before, during or after the operation; (i) what federal standards does this type of operation have to meet; (j) does the company dismantling or transforming the ship have to obtain a certificate of authorization from Environment Canada or any other department before proceeding; (k) what are Canada’s obligations under the Basel Convention in this type of situation; (l) what are the federal government’s and the company’s responsibilities in the event of an environmental accident; (m) has Environment Canada or any other federal department compiled a list or is it aware of other similar operations undertaken elsewhere in Canada; (n) has Environment Canada ever refused to allow an operation of this type to proceed; (o) where is the ship from; and (p) what portion of liability do the federal government and the provincial government bear in this type of situation?

Notwithstanding paragraph 1, Articles 6 and 7 of this Directive shall apply in relation to judicial proceedings following a mediation if, as at the date on which the parties agree to mediate, the court that would be seised in the event of any subsequent judicial proceedings would be in a Member State other than a Member State in which at least one of the parties is domiciled or habitually resident.

Having regard to the objectives of simplicity and cost-effectiveness, the court or tribunal should only order that an unsuccessful party be obliged to pay for the costs of the proceedings, including for example any costs resulting from the fact that the other party was represented by a lawyer or other legal professional, or any costs arising from the service or translation of documents, which are proportionate to the value of the claim or were necessarily incurred.

A solution of this kind threatens on the one hand to lead to confusion over the role of the supervisory authorities, which must remain independent and impartial, and on the other hand to the systematic institution of legal proceedings that can be time-consuming and expensive and which benefit neither the companies concerned, the members of their Boards, nor the other interested parties, and particularly the employees.
