In October 2009, the Commission market tested an improved proposal from Microsoft (see MEMO/09/439).

Even though the contested decision was based on the unreasonable nature of the remuneration rates proposed by Microsoft and not on the refusal to allow access to the interoperability information, the Commission’s acceptance, in the light of the pending case, that Microsoft could apply, for a certain period, a practice that might entail the preservation of a situation which the 2004 decision was intended to bring to an end, could be taken into account in determining the gravity of the conduct found to be unlawful and, therefore, the amount of the periodic penalty payment.

By decision of 27 February 2008 , a fresh periodic penalty payment amounting to €899 million was imposed on Microsoft for the period from 21 June 2006 to 21 October 2007, on the ground that the remuneration rates proposed by Microsoft for granting access to the interoperability information were unreasonable.

Pursuant to the provisions of Article 7 of the Decision, and following insufficient proposals from Microsoft, on 28 July 2005, the Commission addressed to Microsoft Commission Decision C(2005) 2988 (the Trustee Decision), imposing a monitoring mechanism, including the appointment of a Monitoring Trustee.

In July 2009, Microsoft also made proposals in relation to disclosures of interoperability information that would improve interoperability between third party products and several Microsoft products, including Windows, Windows Server, Office, Exchange, and SharePoint (see MEMO/09/352).

However, the Court annulled Article 7 of the Decision in so far as it orders Microsoft to submit a proposal for the establishment of a mechanism which is to include a monitoring trustee with the power to have access, independently of the Commission, to Microsoft's assistance, information, documents, premises and employees and to the source code of the relevant Microsoft products.
