The Union's contribution to democracy and the rule of law and to the promotion and protection of human rights and fundamental freedoms is rooted in the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights, and other human rights instruments adopted within the framework of the United Nations (UN), as well as relevant regional human rights instruments.
La contribution de l'Union à la démocratie et à l'État de droit ainsi qu'à la promotion et à la protection des droits de l'homme et des libertés fondamentales se fonde sur la déclaration universelle des droits de l'homme, le pacte international relatif aux droits civils et politiques, le pacte international relatif aux droits économiques, sociaux et culturels et les autres instruments relatifs aux droits de l'homme adoptés dans le cadre des Nations unies, ainsi que sur les instruments régionaux pertinents en matière de droits de l'homme.

129. Calls on the Member States to follow the call of the 35th International Conference of Data Protection and Privacy Commissioners ‘to advocate the adoption of an additional protocol to Article17 of the International Covenant on Civil and Political Rights (ICCPR), which should be based on the standards that have been developed and endorsed by the International Conference and the provisions in the Human Rights Committee General Comment No 16 to the Covenant in order to create globally applicable standards for data protection and the protection of privacy in accordance with the rule of law’; calls on the Member States to include in this exercise a call for an international UN agency to be in charge of, in particular, monitoring the emergence of surveillance tools and regulating and investigating their uses; asks the High Representative/Vice-President of the Commission and the European External Action Service to take a proactive stance;
129. invite les États membres à donner suite à l'appel lancé lors de la 35 conférence internationale des commissaires à la protection des données et de la vie privée afin de «promouvoir l'adoption d'un protocole additionnel à l'article 17 du Pacte international relatif aux droits civils et politiques (PIDCP). Welcomes the Council's proposals for launching human rights dialogues with a number of Latin American countries; underlines that those dialogues should go hand in hand with firm, concrete and tangible demands in respect of human rights matters, which will equally impose obligations on the EU institutions in their relations with the countries concerned; stresses the desirability of including the countries of Central America; notes the signing of the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights by the Cuban government in February 2008; calls for those Covenants to be ratified without any reservations; asks the Cuban government to release all political prisoners and to honour the rights protected in the signed treaties; notes the Council's decision of 20 June 2008 to lift the informal sanctions with regard to Cuba; notes that the Council will decide in 2009 whether to pursue the political dialogue with Cuba, depending on whether or not there have been significant improvements as regards human rights;

[15] It is important to note that similar data protection principles have been laid down in international instruments regarding the protection of privacy and personal data, such as: Art. 17 of the International Covenant on Civil and Political Rights of 16. December 1966, the UN Guidelines for the Regulation of Computerized Personal Data Files (UN General Assembly Resolution 45/95 of 14 December 1990), the Organisation for Economic Co-operation and Development (OECD) Recommendation of the Council concerning guidelines governing the protection of privacy and trans-border flows of personal data, and the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data (ETS No. 108) and the Additional Protocol to that Convention (ETS No. 181), which are also open to adhesion for non-European States.

(4) The right of all persons to equality before the law and protection against discrimination constitutes a universal right recognised by the Universal Declaration of Human Rights, the United Nations Convention on the Elimination of All Forms of Discrimination against Women, United Nations Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights and by the European Convention for the Protection of Human Rights and Fundamental Freedoms, to which all Member States are signatories.
(4) Le droit de toute personne à l'égalité devant la loi et la protection contre la discrimination constitue un droit universel reconnu par la Déclaration universelle des droits de l'homme, par la Convention des Nations unies sur l'élimination de toutes les formes de discrimination à l'égard des femmes, par les pactes des Nations unies relatifs aux droits civils et politiques et aux droits économiques, sociaux et culturels et par la Convention européenne de sauvegarde des droits de l'homme et des libertés fondamentales signés par tous les États membres.

(3) The right to equality before the law and protection against discrimination for all persons constitutes a universal right recognised by the Universal Declaration of Human Rights, the United Nations Convention on the Elimination of all forms of Discrimination Against Women, the International Convention on the Elimination of all forms of Racial Discrimination and the United Nations Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights and by the European Convention for the Protection of Human Rights and Fundamental Freedoms, to which all Member States are signatories.
