79 According to consistent case-law, the distinctive character of a trade mark within the meaning of Article 7(1)(b) of Regulation No 40/94 means that the mark in question makes it possible to identify the product in respect of which registration is applied for as originating from a particular undertaking, and thus to distinguish that product from those of other undertakings (Joined Cases C‑473/01 P and C‑474/01 P Procter Gamble v OHIM [2004] ECR I‑5173, paragraph 32, and Case C‑64/02 P OHIM v Erpo Möbelwerk [2004] ECR I‑10031, paragraph 42).

However, as the Commission stated already in its reply to oral question H-650/01 from Mr Miquel Mayol I Raynal and written question E-1305/04 from Mr Erik Meijer, the fact that certain regional or co-official languages are not named as one of the official languages of the Union in Council Regulation No 1/58 does not call into question the cultural and linguistic importance of these language.

With regard, in particular, to three-dimensional trade marks consisting of the packaging of goods, such as liquids, which are packaged in trade for reasons linked to the very nature of the product, the Court has held that they must enable average consumers of the goods in question, who are reasonably well informed and reasonably observant and circumspect, to distinguish the product concerned from those of other undertakings without conducting an analytical or comparative examination and without paying particular attention (see, to that effect, with regard to Article 3(1)(b) of First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (OJ 1989 L 40, p. 1), which provision is identical to Article 7(1)(b) of Regulation No 40/94, Case C‑218/01 Henkel [2004] ECR I‑1725, paragraph 53).

In reply to question P-2088/01, the Commission states that ‘Regulation (EC) 1038/2001 does not have the purpose of alleviating the shortage of vegetable protein arising from the ban on the use of meat and bone meal in animal feed’.

The result, as the Commission has already stated in its replies to Oral Question H-0364/01 during Question Time at the plenary session of Parliament in May 2001 and written question P-1794/01 put by the Honourable Member, is that the requirements laid down in Article 4 of Directive 92/46/EEC are only applicable in cases where a Member State authorises the placing on the market of milk intended for direct human consumption, whereas under Article 7(A)(9), each Member State has to lay down its own health rules for milk-based products which are not made from heat-treated milk or which have not been subjected to any heat treatment during their manufacturing process, and those rules must be sufficient to enable such products to meet the health criteria guaranteed for every finished product.

Ms. Levman: With regard to your first question about sentencing, as my colleague from the RCMP indicated, we have five convictions under section 279.01, which is understandable given that it was enacted fairly recently.
