7. Where the child is to be assisted by a lawyer in accordance with this Article but no lawyer is present, the competent authorities shall postpone the questioning of the child, or other investigative or evidence-gathering acts provided for in point (c) of paragraph 4, for a reasonable period of time in order to allow for the arrival of the lawyer or, where the child has not nominated a lawyer, to arrange a lawyer for the child.
7. Where, in the course of such questioning, a child other than a suspect or accused person becomes a suspect or accused person, questioning should be suspended until the child is made aware that he or she is a suspect or accused person and is assisted by a lawyer in accordance with this Directive.

Where an audiovisual recording is to be made in accordance with this Directive but an insurmountable technical problem renders it impossible to make such a recording, the police or other law enforcement authorities should be able to question the child without it being audio-visually recorded, provided that reasonable efforts have been made to overcome the technical problem, that it is not appropriate to postpone the questioning, and that it is compatible with the child's best interests.

In order to ensure sufficient protection of such children, questioning by police or by other law enforcement authorities should therefore be audio-visually recorded where it is proportionate to do so, taking into account, inter alia, whether or not a lawyer is present and whether or not the child is deprived of liberty, it being understood that the child's best interests should always be a primary consideration.

2. Where the suspect or accused person is a child, Member States shall ensure that the child’s legal representative or another adult, depending on the interest of the child, is informed as soon as possible of any deprivation of liberty and the reasons pertaining thereto, may visit the child and may attend any interview of the child and any proceedings, unless it would be contrary to the best interests of the child, in which case another appropriate adult shall be informed and granted the right to visit the child and be present during questioning and proceedings.
2. Child labour is an issue of great concern to Members of the European Parliament and they have expressed it regarding child labour in general, and exploitation and trafficking of minors in cocoa sector in particular, in numerous resolutions and questions to Commission, calling for a ban on child labour in trade and possible introduction of "child-labour free" product labelling.
