In two recent judgments connected with European elections, the Gibraltar case (C-145/04, Spain v. UK ) and the Aruba case (C-300/04, Eman en Sevinger ), the European Court of Justice made the important point that although the Member States have discretion in regulating those aspects of electoral procedure for the European Parliament (EP) elections which are not harmonised at EU level, they must respect general principles of EU law, under the control of the Court of Justice.
