(48) In order to ensure uniform conditions for the implementation of this Regulation as regards exports, implementing powers should also be conferred on the Commission in respect of measures defining the procedures for declaring and the evidence needed to prove the composition of the exported non-Annex I goods necessary for the implementation of the export refund system, the simplified evidence needed to prove arrival at destination in the case of differentiated refunds, measures on the application of horizontal provisions on export refunds for non-Annex I goods, measures on the implementation of the export refund certificate system as regards the submission, the format and the content of the application for the refund certificate, the format, the content and the period of validity of the refund certificate, the procedure for lodging applications and issuing refund certificates and for their use, the procedure for lodging a security and its amount, the level of tolerance for the amounts of export refund which were not applied for and the means of proving that the obligations derived from the refund certificate have been fulfilled.
(48) Afin d'assurer des conditions uniformes d'exécution du présent règlement en ce qui concerne les exportations, il convient de conférer des compétences d'exécution à la Commission en vue d'adopter des mesures définissant les procédures relatives à la déclaration et les éléments nécessaires pour prouver la composition des marchandises hors annexe I exportées nécessaires à la mise en œuvre du système de restitution à l'exportation, des règles sur la preuve simplifiée de l'arrivée à destination dans le cas de restitutions différenciées, des mesures sur l'application, aux marchandises hors annexe I, de dispositions horizontales relatives aux restitutions à l'exportation, des mesures sur la mise en œuvre du système de certificats de restitution à l'exportation en ce qui concerne le format et le contenu et la période de validité du certificat de restitution, la procédure pour l'introduction de demandes et la délivrance de certificats de restitution et pour leur utilisation, la procédure de constitution de garantie et le montant de celle-ci , le niveau de tolérance pour les montants des restitutions à l'exportation qui n'ont pas été demandées et les moyens de preuve que les obligations découlant du certificat de restitution ont été remplies.

EU export refunds have always provoked strong criticism from developing countries. Given the current economic situation, it seems a good moment to abolish them now for cereals and for rice, all the more so since the Commission has already planned, in the framework of the Doha talks, to propose abolishing these export refunds.

According to the European Tax Survey a great number of 53% of traders do not reclaim the VAT charged to them in the country where expenses have occurred. The reasons for that are, as mentioned above, the lengthy time and burdensome administrative procedure to receive the refunds due.

À l'évidence, un constat s'impose au regard des objectifs contenus dans le règlement 2759/75 modifié, celui de l'inadaptation et de l'insuffisance des outils de l'OCM du secteur de la viande porcine, à savoir le stockage privé et les restitutions : le stockage privé, qui intéresse d'autant moins les opérateurs qu'il est mis en œuvre dans un contexte de crise structurelle, et les restitutions, toujours utiles, mais dépendantes des accords internationaux qui les limitent de plus en plus sévèrement.
