11. By means of Decision No 7185 of 6 December 2006 the Council of State accepted the appeal lodged by Mr Beniamino Donnici against the ruling issued by the Lazio Regional Administrative Tribunal and it amended that ruling on the basis of the following arguments:
11. Par décision n° 7185 du 6 décembre 2006, le Conseil d'État, Ve section, a fait droit à l'appel formé par Beniamino Donnici contre l'arrêt du tribunal administratif régional du Latium en réformant cet arrêt selon les arguments suivants:

By means of Ruling No 6232 of 21 July 2006 the Regional Administrative Tribunal rejected Mr Beniamino Donnici's appeal on the grounds that a withdrawal expressed with a view to the proclamation of elected representatives did not constitute a withdrawal from a position on a list, since respect for the will of the people requires that electoral results be regarded as unalterable and has no effect when any acts of substitution are being adopted in the event of incompatibility, loss of civil rights, ineligibility or resignation from an appointment or position on the part of those officially entitled to them.

Par arrêt n° 6232 du 21 juillet 2006, le tribunal administratif régional a rejeté le recours de Beniamino Donnici en faisant valoir que la renonciation, exprimée relativement à la proclamation des élus, ne vaut pas renonciation à sa place dans l'ordre de classement, car le respect de la volonté populaire impose de considérer les résultats électoraux comme indisponibles et non modifiables et demeure sans effet sur l'adoption des éventuels actes de subrogation en cas d'incompatibilité, de déchéance, d'inéligibilité ou de renonciation à la nomination ou au mandat de la part des ayants droits.

By means of an appeal submitted on 30 May 2006 to the Lazio Regional Administrative Tribunal (RG No 5258/2006), Mr Beniamino Donnici challenged the action taken by the National Electoral Office on the grounds that it was illegitimate, since it infringed Articles 20, 21, 22 and 41 of Law No 18 of 24 January 1979 and also the general principles relating to elections, and since Mr Achille Occhetto had been declared elected, even though he had withdrawn on 7 July 2004, which meant that he did not appear on the list of the elected candidates and the possible substitutes which had been forwarded to the European Parliament on 12 November 2004.

Beniamino Donnici a contesté, par un recours devant le tribunal administratif régional du Latium en date du 30 mai 2006 (inscription au greffe n° 5258/2006), la décision du Bureau électoral national, en déduisant son caractère illégitime de l'annulation des articles 20, 21, 22 et 41 de la loi n° 18 du 24 janvier 1979, ainsi que des principes généraux régissant les élections, et de la proclamation comme élu d'Achille Occhetto, qui avait renoncé dès le 7 juillet 2004 à l'élection et ne figurait donc plus sur la liste des candidats élus et des éventuels remplaçants, transmise au Parlement européen le 12 novembre 2004.

In 2002, the autonomous region of Friuli-Venezia Giulia and the regional agency for rural development asked the Tribunal amministrativo regionale del Lazio (Lazio Regional Administrative Court) to annul the national legislation implementing the prohibition provided for by the agreement.
