(162) The objectives of this Regulation, namely to lay down animal health rules for animals, germinal products, products of animal origin, animal by-products and derived products to the extent that they are not covered by specific rules in other Union legislation and other material that can be involved in the spread of transmissible animal diseases, cannot be achieved sufficiently by the Member States, and can be more efficiently achieved at Union level through a common and coordinated legal framework for animal health.

Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption (3) lays down animal and public health rules for the collection, transport, storage, handling, processing and use or disposal of animal by-products, to prevent those products from presenting a risk to animal or public health.
Le règlement (CE) no 1774/2002 du Parlement européen et du Conseil du 3 octobre 2002 établissant des règles sanitaires applicables aux sous-produits animaux non destinés à la consommation humaine (3) établit les règles sanitaires et de police sanitaire applicables à la collecte, au transport, à l’entreposage, à la manipulation, à la transformation et à l’utilisation ou l’élimination des sous-produits animaux, visant à éviter tout risque que ces produits pourraient entraîner pour la santé animale ou la santé publique.

(12) The rules on animal by-products laid down in this Regulation should apply to products that may not be used for human consumption under Community legislation, in particular where they do not comply with food hygiene legislation (animal by-products "by law"). Those rules should, however, also apply to products which do comply with certain rules regarding their possible use for human consumption, even if they are eventually destined for other purposes (animal by-products "by choice").
(12) Les dispositions du présent règlement relatives aux sous-produits animaux doivent s’appliquer non seulement aux produits impropres à la consommation humaine selon la législation communautaire, notamment aux produits non conformes à la législation sur l’hygiène des denrées alimentaires (sous-produits animaux «en application de la loi»), mais également aux produits remplissant certaines conditions pour être utilisés dans l’alimentation humaine, même s’ils peuvent être utilisés à d’autres fins (sous-produits animaux «par choix»).

“products” means the products of animal origin referred to in Directives 89/662/EEC and 90/425/EEC, in Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption , in Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption and in Regulation (EC) No 854/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific rules for the organisation of official controls on products of animal origin intended for human consumption ; it also includes the plant products referred to in Article 19.

The official veterinarian is to verify compliance with relevant Community and national rules on animal welfare, such as rules concerning the protection of animals at the time of slaughter and during transport.

(5) The rules governing animal health conditions for the importation of live animals pursuant to Directive 72/462/EEC, in particular the provisions of Article 3 referring to a list of third countries authorised for the exportation of live animals, will be replaced by a Council directive(17) laying down the animal health rules for the importation into the Community of certain live animals and amending Directives 72/462/EEC, 90/426/EEC, 92/65/EEC and 97/78/EC.

(4) Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption(8), as amended by Commission Regulation (EC) No 808/2003(9), lays down animal and public health rules for the collection, transport, storage, handling, processing and use or disposal of animal by-products, including conditions for their use in animal feeding.
(4) Le règlement (CE) n° 1774/2002 du Parlement européen et du Conseil du 3 octobre 2002 établissant des règles sanitaires applicables aux sous-produits animaux non destinés à la consommation humaine(8), modifié par le règlement (CE) n° 808/2003 de la Commission(9), établit les règles sanitaires et de police sanitaire applicables à la collecte, au transport, à l'entreposage, à la manipulation, à la transformation et à l'utilisation ou l'élimination des sous-produits animaux, y compris les conditions relatives à leur utilisation dans l'alimentation des animaux.
