Nor, since the Home Secretary had, by order of 23 June 2008 which entered into force the following day, struck the PMOI’s name from the list of organisations proscribed under the Terrorism Act 2000, could the Home Secretary’s order of 28 March 2001, a decision of a competent authority that formed the basis for Decision 2007/868, any longer serve as grounds for the inclusion of the PMOI in the list referred to in Article 2(3) of Regulation No 2580/2001, on pain of contravening Article 1(4) of Common Position 2001/931.
Depuis que, par ordonnance du 23 juin 2008, entrée en vigueur le jour suivant, le Home Secretary avait radié le nom de la PMOI de la liste des organisations proscrites au titre du Terrorism Act 2000, l’ordonnance du Home Secretary du 28 mars 2001, décision d’une autorité compétente qui avait fondé la décision 2007/868, n’aurait plus pu servir de base à l’inscription de la PMOI dans la liste visée à l’article 2, paragraphe 3, du règlement n° 2580/2001, sous peine d’une violation de l’article 1 , paragraphe 4, de la position commune 2001/931.
