Pour résoudre ce problème, on pourrait penser à introduire, au niveau de l'Union européenne, un délai minimum au cours duquel un condamné continuerait à purger sa peine dans l'État de condamnation afin d'éviter qu'il soit immédiatement libéré suite au transfert dans l'État d'exécution ou qu'il purge une peine beaucoup moins sévère que celle imposée par l'État de condamnation.
