Strongly welcomes the UN report dated 25 January 2011 highlighting 25 proposals made by Jack Lang, Special Adviser to the UN Secretary-General on legal issues related to piracy off the coast of Somalia; also welcomes the relevant follow-up reports by Jack Lang such as the report on the modalities for the establishment of specialised Somali anti-piracy courts of 15 June 2011 and the report of the Secretary-General on specialised anti-piracy courts in Somalia and other states in the region of 20 January 2012; urges the HR/VP, the EUSR and the three HoMs and HoDs to act on the proposals made by Jack Lang as a matter of priority and to develop an strategy for the EU’s contribution to the international approach to criminal justice on the territory of Somalia;
10. accueille très favorablement le rapport des Nations unies du 25 janvier 2011 en mettant en lumière les vingt-cinq propositions formulées par Jack Lang, conseiller spécial du Secrétaire général des Nations unies sur les questions juridiques liées à la piraterie au large de la Somalie; accueille aussi favorablement les rapports de suivi de Jack Lang tels que le rapport sur les modalités de création de tribunaux somaliens spécialisés contre la piraterie du 15 juin 2011 et le rapport du Secrétaire général du 20 janvier 2012 sur des tribunaux spécialisés dans la lutte contre la piraterie en Somalie et dans d'autres États de la région; prie instamment la VP/HR, le RSUE et les trois chefs de mission ou de délégation d'agir en priorité à partir des propositions de Jack Lang et d'élaborer une stratégie pour la contribution de l'Union à l'approche internationale de la justice pénale sur le territoire de la Somalie;

The EESC urged the Commission to examine the anti-piracy training of seafarers with the Member States.
Il a pressé la Commission d'examiner avec les États membres la formation qui leur est dispensée en matière de lutte antipiraterie.

11. In this regard calls for immediate and effective measures to prosecute and punish those suspected of acts of piracy and urges third counties and the EU Member States that have not yet done so to transpose into their national law all the provisions laid down by the UN Convention on the Law of the Sea and the UN Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation, in order to tackle the impunity of pirates, and calls on the Council and the Commission to continue examining opportunities for trial in the countries of the region and to work on the creation of specialised anti-piracy courts in Somalia and in other states in the region as a sustainable judicial solution for prosecuting pirates in Somalia;
11. demande, à cet égard, que des mesures immédiates et effectives soient prises afin de poursuivre et de punir les personnes suspectées d'actes de piraterie, et prie instamment les pays tiers et les États membres de l'Union qui ne l'ont pas encore fait de transposer dans leur droit national toutes les dispositions énoncées dans la convention des Nations unies sur le droit de la mer et la convention des Nations unies pour la répression d'actes illicites contre la sécurité de la navigation maritime afin de faire face à l'impunité des pirates; invite le Conseil et la Commission à continuer d'étudier les possibilités de procès dans les pays de la région et à œuvrer en faveur de la mise en place d'un tribunal international spécial pour la lutte contre la piraterie en Somalie et dans les autres États de la région, de sorte que soit trouvée une solution judiciaire durable pour la poursuite des pirates en Somalie;

Some Member States brought in new, comprehensive anti-discrimination legislation, although anti-discrimination measures can be found in many Member States’ constitutional provisions as well as in both civil and criminal legislation, which can make it difficult to identify the applicable procedure.
Certains États membres ont mis en place une législation nouvelle et exhaustive pour lutter contre la discrimination, bien que dans de nombreux États membres, des dispositions anti-discriminatoires soient inscrites dans la Constitution ainsi que dans le droit civil et pénal, de sorte qu'il est parfois difficile de déterminer la procédure applicable.

Taking account existing and planned anti-counterfeiting and anti-piracy instruments and measures, including those in the enforcement[13] and customs fields, the Commission will review the state of progress in the whole area of IPR with a focus on competitiveness issues and come up with suggestions on how to improve the situation in 2006.

The Directive introduces only a minimum level of legal protection against piracy and grants Member States a lot of flexibility and discretion in tailoring their national anti-piracy regime to their own needs and policies.
