IN-CONTEXT TRANSLATIONS

Whereas pursuant to paragraph eleven of the Terms of Union between the Dominion of Canada and the then Colony of British Columbia and to certain statutes of the Legislature of the Province of British Columbia, being chapter eleven of the statutes of the year eighteen hundred and eighty, chapter fourteen of the statutes of the year eighteen hundred and eighty-three, and chapter fourteen of the statutes of the year eighteen hundred and eighty-four, there were granted by the Province to Canada certain Crown lands in the Province by way of consideration for Canada’s undertaking to secure the construction of a railway to connect the seaboard of the Province with the railway system of Canada and of Canada’s paying to the Province from the date of the Union an annual sum of one hundred thousand dollars, the said Crown lands being defined in the statutes aforesaid and having become known as the Railway Belt and the Peace River Block;
Considérant que, en conformité du paragraphe onze des Conditions de l’Union entre le Dominion du Canada et la Colonie d’alors de la Colombie britannique, et de certaines lois de la Législature de la province de la Colombie britannique, étant le chapitre onze du statut de l’année mil huit cent quatre-vingt, le chapitre quatorze du statut de l’année mil huit cent quatre-vingt-trois, et le chapitre quatorze de l’année mil huit cent quatre-vingt-quatre, la province a concédé au Canada certaines terres de la Couronne situées dans la province en considération du fait que le Canada a entrepris d’assurer la construction d’un chemin de fer pour relier le littoral de la province au réseau ferroviaire du Canada, et vu que le Canada a versé à la province à compter de la date de l’Union une somme annuelle de cent mille dollars, lesdites terres de la Couronne étant définies dans les lois susdites et étant connues sous le nom de Zone du chemin de fer et du Bloc de la rivière La Paix;

Yukon shall be bounded as follows: On the south, by the Province of British Columbia and the State of Alaska; on the west, by the said State of Alaska; on the north, by that part of the Arctic Ocean called Beaufort Sea; and on the east, by a line beginning at the intersection of the north boundary of British Columbia with a line passing through a boundary pipe post set in concrete, trench and mound, numbered 600, planted by the British Columbia-Yukon-Northwest Territories Boundary Commission approximately 1 chain westerly of the left bank of the Liard River, said line having a bearing of 309 degrees with reference to the meridian through said post; thence northwesterly along said line to a point on the line of watershed separating the streams flowing into the Liard River below the La Biche River or into the Mackenzie River from those flowing into the La Biche River, into the Liard River above the La Biche River, or into the Yukon River; thence northwesterly along said line of watershed to the line of watershed of the basin of Peel River; thence northerly along the line of watershed between the Peel and Mackenzie Rivers to the sixty-seventh degree of north latitude; thence westerly along the parallel of the sixty-seventh degree of north latitude to the line of watershed between the Peel and Yukon Rivers; thence northerly along the said line of watershed to the trail across the portage in McDougall Pass between Rat and Bell Rivers; thence due north to the northern limit of the Yukon territory; the said territory to include the islands within twenty statute miles from the shores of the Beaufort Sea as far as the aforesaid due north line from McDougall Pass.

7. The School Lands Fund to be transferred to the Province as aforesaid, and such of the school lands specified in section thirty-seven of the Dominion Lands Act, being chapter one hundred and thirteen of the Revised Statutes of Canada, 1927, as pass to the administration of the Province under the terms hereof, shall be set aside and shall continue to be administered by the Province in accordance, mutatis mutandis, with the provisions of sections thirty-seven to forty of the Dominion Lands Act, for the support of schools organized and carried on therein in accordance with the law of the Province.
7. La caisse des terres des écoles à transférer à la province comme susdit et les terres des écoles mentionnées à l’article trente-sept de la Loi des terres fédérales, chapitre cent treize des Statuts revisés du Canada, 1927, qui passent sous l’administration de la province en vertu des conditions stipulées aux présentes, doivent être mises de côté et continuer d’être administrées par la province, d’accord, mutatis mutandis, avec les dispositions des articles trente-sept à quarante de la Loi des terres fédérales, pour subvenir aux écoles y organisées et administrées conformément à la loi de la province.

9. Every sale, lease or other disposition heretofore made under the Great Seal of Canada or otherwise under the direction of the Government of Canada of lands which were at the time of such sale, lease or other disposition included in any Indian Reserve in the Province of Ontario, is hereby confirmed, whether or not such sale, lease or other disposition included the precious metals, but subject to the provisions of the aforesaid statute of the Province of Ontario entitled “The Bed of Navigable Waters Act”, and the consideration received in respect of any such sale lease or other disposition shall be and continue to be dealt with by the Dominion of Canada in accordance with the provisions of the paragraph of this agreement numbered 1, and the consideration received in respect of any sale, lease or other disposition heretofore made under the Great Seal of the Province of Ontario, or under the direction of the Government of the said Province, of any lands which at any time formed part of any Indian Reserve, shall remain under the exclusive control and at the disposition of the Province of Ontario.
9. Toute vente, location ou autre aliénation faite jusqu’à présent sous le grand sceau du Canada ou autrement sous la direction du gouvernement du Canada, de terres qui étaient, à l’époque de cette vente, location ou autre aliénation, incluses dans quelque réserve de sauvages de la province d’Ontario, est par les présentes confirmée, que cette vente, location ou autre aliénation comprenne ou non des métaux précieux, mais subordonnément aux dispositions du susdit statut de la province d’Ontario intitulé : « The Bed of Navigable Waters Act »; et la considération reçue relativement à toute pareille vente, location ou autre aliénation est et continue d’être administrée par le Dominion du Canada en conformité des dispositions de l’article numéro 1 du présent traité et la considération reçue relativement à toute vente, location et autre aliénation faite jusqu’à présent sous le grand sceau de la province d’Ontario, ou sous la direction du gouvernement de ladite province, de toutes terres qui, à une époque quelconque, firent partie de quelque réserve de sauvages, reste sous le contrôle exclusif et à la disposition de la province d’Ontario.

Whereas the Council is to determine, pursuant to the aforesaid provisions, the composition of that court and adopt the necessary adjustments and additional provisions to the Statutes of the Court of Justice;

Whereas the aforesaid provisions empower the Council to give the Court of First Instance jurisdiction to hear and determine at first instance, in accordance with the conditions laid down by the Statutes, certain classes of action or proceeding brought by natural or legal persons, subject to the right of appeal to the Court of Justice on questions of law alone;
considérant que ces mêmes dispositions habilitent le Conseil à attribuer au tribunal de première instance compétence pour connaître en première instance, sous réserve d'un pourvoi porté devant la Cour de justice et limité aux questions de droit, dans les conditions fixées par les statuts, de certaines catégories de recours formés par des personnes physiques ou morales; que le Conseil fixe, en vertu des dispositions précitées, la composition de cette juridiction et adopte les adaptations et les dispositions complémentaires qu'il convient d'apporter aux statuts de la Cour de justice;
