C. whereas the Dayton Agreement, in particular Annex 4 thereto, provided a constitution for BiH, which is still in use today; whereas, however, these constitutional arrangements make the decision-making capacity and functioning of institutions difficult and inefficient by keeping Bosnian society divided along ethnic lines; whereas the constitutionally based discrimination which prevents citizens who do not declare themselves as belonging to one of the country’s constituent peoples from standing as candidates in elections is in breach of the European Convention on Human Rights;
