The addition of Article 141 of the EC Treaty to the legal basis in the proposal now under consideration – the proposal thus has a combined legal basis consisting of Article 137(2), providing for workers’ safety and health to be protected, and Article 141(3) of the TEC, relating to the promotion of equal opportunities for men and women – makes the directive conceptually better balanced.

Points out that the subsidiarity principle applies to human genetics and maintains that the Union can and must exercise the powers which the Treaty has conferred on it as regards health (Article 152 TEC), the operation of the internal market (Article 95 TEC), and the financing of research (Articles 163 to 173 TEC), freedom of establishment (Article 47(2) TEC), freedom to provide services (Article 47(2) in conjunction with Article 55 TEC) and workers' rights (Article 137(1) and (2) TEC;

The rapporteur has taken inspiration not only from the Directive based on the Fixed Term Work agreement concluded by the European social partners (99/70/TEC) (which in turn is based to a large extent on the Part Time Work Directive 97/81/TEC), but also from the Posting of Workers Directive (96/71/TEC) and the ILO Convention (C181) and Recommendation (R188) that were adopted in the tripartite International Labour Conference in 1997 with overwhelming support and consensus between the parties.
