IN-CONTEXT TRANSLATIONS

Unless otherwise specified in this chapter, this Regulation and the acts adopted pursuant to this Regulation shall apply to applications for international registrations under the Madrid Protocol (‘international applications’), based on an application for an EU trade mark or on an EU trade mark and to registrations of marks in the international register maintained by the International Bureau of the World Intellectual Property Organisation (‘international registrations’ and ‘the International Bureau’, respectively) designating the Union.

2. Where an international registration designating the Union is found to be ineligible for protection pursuant to Article 33(4) or Article 42(1) of this Regulation for all or any part of the goods and services for which it has been registered by the International Bureau, the Office shall issue an ex officio provisional notification of refusal to the International Bureau, in accordance with Article 5(1) and (2) of the Madrid Protocol.
2. S'il est estimé que la protection ne peut être accordée à un enregistrement international désignant l'Union conformément à l'article 33, paragraphe 4, ou à l'article 42, paragraphe 1, du présent règlement, pour tout ou partie des produits et services pour lesquels il a été effectué par le Bureau international, l'Office envoie au Bureau international une notification de refus provisoire ex officio, conformément à l'article 5, paragraphes 1 et 2, du protocole de Madrid.

24. Deplores the European Civil Service Tribunal judgment published on 22 May 2014 condemning the EESC for breaching the Charter of Fundamental Rights of the European Union when dismissing one of its staff members in 2013; also deplores the ruling handed down on 8 October 2014 in Case T-530/12 P, M. B. G. v EESC, in which the General Court found against the EESC in connection with the reporting of irregularities concerning the former Secretary-General by the head of the EESC Legal Service; calls on the EESC and its new Secretary-General to take the steps required to prevent further serious breaches of the Charter of Fundamental Rights of the European Union, to inform the EESC Bureau, the members, and the entire staff about the content of the two judgments, and to draw their attention to the fact that officials and other staff covered by the Staff Regulations have an obligation to report irregularities and that the EESC Bureau is an appropriate body to receive such reports; also asks to be informed about the total legal expenses incurred in the last five years in staff cases ultimately dealt with in the courts or by the Ombudsman;
24. déplore l'arrêt rendu le 22 mai 2014 par le Tribunal de la fonction publique de l'Union européenne, qui condamne le CESE pour avoir enfreint la charte des droits fondamentaux de l'Union européenne lors du licenciement d'un de ses agents en 2013; regrette aussi l'arrêt rendu le 8 octobre 2014 par le Tribunal de l'Union européenne, dans l'affaire T- 530/12 P, M. B.G. c/CESE dans laquelle le CESE a été condamné dans le cadre de la dénonciation d'irrégularités contre l'ancien secrétaire général de la part du chef du service juridique du CESE; demande au CESE et à son nouveau secrétaire général de prendre les mesures adéquates pour éviter que ne se reproduisent des infractions graves à la charte des droits fondamentaux de l'Union, d'informer son bureau, les membres et l'ensemble de son personnel sur le contenu des deux arrêts, ainsi que sur l'obligation des fonctionnaires et du personnel statutaire de dénoncer les irrégularités et sur le fait que le bureau du CESE est un organe compétent pour recevoir ce type de dénonciations; lui demande également de l'informer des frais juridiques totaux encourus au cours des cinq dernières années pour des affaires concernant le personnel qui ont abouti devant les tribunaux ou devant le Médiateur.

Notes that at its meeting of 22 October 2007, the Bureau decided not to comply with a recommendation by the European Ombudsman (complaint 655/2006/(SAB)ID) that Parliament should give access to the list of members of the voluntary pension scheme, notwithstanding a positive opinion of the European Data Protection Supervisor; calls on the Bureau to reconsider its position and to publish the list in accordance with the advice of Parliament's Legal Service and in line with the transparency policy of the Union so as to make public all final beneficiaries of European funding;

3. The Commission shall forward the individual Country Profile Forms completed by the Member States to the Permanent Bureau of the Hague Conference on Private International Law (‘the Permanent Bureau’) at the time when the Union deposits the instrument referred to in Article 58(2) of the Convention.
3. La Commission transmet les formulaires du profil des États remplis par les États membres au bureau permanent de la Conférence de La Haye de droit international privé (le bureau permanent) lorsque l’Union dépose l’instrument visé à l’article 58, paragraphe 2, de la convention.

The Commission should forward that information to the Permanent Bureau of the Hague Conference on Private International Law (‘the Permanent Bureau’) at the time when the Union deposits its instrument of approval, as required by the Convention.
La Commission devrait transmettre ces informations au bureau permanent de la Conférence de La Haye de droit international privé (ci-après dénommé «le bureau permanent») au moment où l’Union dépose son instrument d’approbation, comme l’exige la convention.
