Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). Is the term ‘[consumption of] energy products’ in Article 1(1)(a) of Council Directive 2008/118/EC (1) of 16 December 2008 concerning the general arrangements for excise duty and repealing Directive 92/12/EEC (2) to be interpreted — in cases involving energy products which have been released for free circulation and are removed from a tax warehouse of an authorised warehouse keeper, sold in a commercial transaction to a purchaser which possesses neither an authorisation for the production of electricity nor a certificate as an end user exempt from excise duty, and which are then resold by that purchaser to a third party which possesses an authorisation for the production of electricity, a permit from the competent authorities of the Member State for receiving duty-free energy products and a certificate as an end user exempt from excise duty, and to which the energy products are delivered directly by the authorised warehouse keeper, without coming under the actual control of the purchaser — as meaning that the energy products are consumed by their direct purchaser, which does not in fact put them to use in a particular operation, or as meaning that they are consumed by the third party, which does in fact put them to use in an operation which it carries out?

Il y a lieu d’adopter également des actes délégués pour préciser à quelles conditions la délégation des fonctions de gestionnaire peut être approuvée et à quelles conditions un gestionnaire a délégué ses fonctions dans une mesure telle qu’il est devenu une société boîte aux lettres et ne peut plus être considéré comme un gestionnaire de FIA; en ce qui concerne les dépositaires, pour établir les critères permettant d’évaluer si la réglementation et la surveillance prudentielles des pays tiers dans lesquels sont établis les dépositaires produisent les mêmes effets que le droit de l’Union et sont effectivement appliquées, les indications qui doivent figurer dans l’accord standard; les conditions de l’exercice des fonctions de dépositaire, y compris le type d’instruments financiers qui devraient figurer dans le champ d’application des devoirs de conservation du dépositaire, les conditions auxquelles le dépositaire peut exercer ses devoirs de conservation sur des instruments financiers enregistrés auprès d’un dépositaire central et les conditions auxquelles le dépositaire devrait garder les instruments financiers émis sous une forme nominative et enregistrés auprès d’un émetteur ou d’un teneur de registre, les obligations quant à la diligence requise des dépositaires, l’obligation de dissociation des actifs, les conditions et circonstances dans lesquelles les instruments financiers conservés devraient être considérés comme perdus; ce qu’il faut entendre par événements extérieurs échappant à un contrôle raisonnable, dont les conséquences n’auraient pas pu être évitées même si tous les efforts raisonnables avaient été déployés pour les contrer; et les conditions et circonstances dans lesquelles il existe une raison objective d’envisager par contrat une décharge de responsabilité.

The CFI, by failing to order the disclosure of the evidence requested, has infringed the fundamental right to a fair trial to which the applicant is entitled, by refusing to assess evidence which is essential to the applicant's case thereby infringing its rights of defence, since its application was dismissed on the ground that it had not proved what it specifically sought to establish with the evidence which was not produced: if not the Commission's final position with respect to the complaint of 1994 against the tax rules of 1993 (including a tax credit), which are measures which are essentially the same as the contested measure, which rejected that complaint, then at least the attitude of the Commission which would constitute an exceptional circumstance in so far as its conduct gave rise to a legitimate expectation that the 1993 tax measures were lawful, which led to the adoption of the contested tax measure in 1996.
En ne faisant pas droit à l’offre de preuve demandée, le Tribunal a violé le principe fondamental à un procès équitable duquel peut se prévaloir la requérante, étant donné qu’il a rejeté une offre de preuve qui s’avère essentielle pour la requérante, en violant ainsi ses droits de défense, dans la mesure où sa demande a été rejetée sur la base du fait qu’elle n’a pas établi ce qu’elle entendait précisément établir à l’aide de l’offre de preuve rejetée: à savoir, si ce n’est la position explicite définitive de la Commission par rapport à la plainte de 1994 à l’encontre d’une disposition en substance identique adoptée en 1993, en la rejetant, au moins son attitude qui serait constitutive d’une circonstance exceptionnelle en ce qu’elle aurait engendré une confiance légitime dans la légalité des dispositions fiscales de 1993, ce qui a conduit à l’adoption de la disposition fiscale litigieuse en 1996.

An undertaking which has a very large market share and holds it for some time, by means of the volume of production and the sale of the supply which it stands for - without holders of much smaller market shares being able to meet rapidly the demand from those who would like to break away from the undertaking which has largest market share - is by virtue of that share in a position of strength which makes it an unavoidable trading partner and which, because of this alone, secures for it, at the very least during relatively long periods, that freedom of action which is the special feature of a dominant position", Case AAMS and Others v Commission, op. cit., paragraph 51.

(19) The place at which a service provider is established should be determined in conformity with the case-law of the Court of Justice according to which the concept of establishment involves the actual pursuit of an economic activity through a fixed establishment for an indefinite period; this requirement is also fulfilled where a company is constituted for a given period; the place of establishment of a company providing services via an Internet website is not the place at which the technology supporting its website is located or the place at which its website is accessible but the place where it pursues its economic activity; in cases where a provider has several places of establishment it is important to determine from which place of establishment the service concerned is provided; in cases where it is difficult to determine from which of several places of establishment a given service is provided, this is the place where the provider has the centre of his activities relating to this particular service.
(19) Le lieu d'établissement d'un prestataire devrait être déterminé conformément à la jurisprudence de la Cour de justice, selon laquelle le concept d'établissement implique l'exercice effectif d'une activité économique au moyen d'une installation stable et pour une durée indéterminée. Cette exigence est également remplie lorsqu'une société est constituée pour une période donnée. Le lieu d'établissement d'une société fournissant des services par le biais d'un site Internet n'est pas le lieu où se situe l'installation technologique servant de support au site ni le lieu où son site est accessible, mais le lieu où elle exerce son activité économique. Dans le cas où un prestataire a plusieurs lieux d'établissement, il est important de déterminer de quel lieu d'établissement le service concerné est presté. Dans les cas où il est difficile de déterminer, entre plusieurs lieux d'établissement, celui à partir duquel un service donné est fourni, le lieu d'établissement est celui dans lequel le prestataire a le centre de ses activités pour ce service spécifique.
