Consequently, in the case where the employee carries out hisactivities in more than one Contracting State, the Convention must be construed as guaranteeing the applicability of the first criterion referring to the law of the State in which the employee, in the performance of the contract, performs the greater part of his obligations towards his employer and thus to the law of the place in which or from which the employee actually carries out his working activities and, in the absence of such a centre of activities, to the law of the place where the employee carries out the greater part of his activities.
Dès lors, lorsqu’il exerce ses activités dans plus d’un État contractant, la convention doit être lue comme garantissant l’applicabilité du premier critère qui renvoie à la loi de l’État dans lequel le travailleur, dans l’exécution du contrat, s’acquitte de l’essentiel de ses obligations à l’égard de son employeur et ainsi à la loi du lieu dans lequel ou à partir duquel le travailleur exerce effectivement ses activités professionnelles et, en l’absence d’un centre d’affaire, à la loi du lieu où celui-ci accomplit la majeure partie de ses activités.
