With reference to the amount of the fine, the appellants allege by their third ground of appeal that the General Court infringed the principle of equal treatment when it did not — as in the parallel case Gigaset — reduce the fines against the appellants in light of the errors in calculating the fine, in particular the failure to take into account an entrance fee and the incorrect taking into account of a leniency reduction in SKW’s fine.

Although consolidated data on the number of decisions adopted and penalties imposed by national enforcement authorities are not available, the following representative examples can be provided: between the entry into force of the Directive and mid 2011, the Italian Competition Authority issued more than 700 decisions and applied administrative fines totalling € 91 million; the French General Directorate for Competition, Consumer Issues and Fraud Control (DGCCRF) issued 1251 Reports[124] and corresponding fines amounting to approximately € 1.7 million were imposed; [125] the Latvian Consumer Rights Protection Centre took 154 binding decisions and imposed fines of € 159 400; the Finnish Consumer Ombudsman initiated 8 court cases; the Irish National Consumer Agency issued 14 undertakings, 116 compliance notices, 2 prohibition orders, and started 2 prosecutions; the Slovak Trade Inspection issued 46 administrative decisions and imposed a total amount of € 151 800 in fines; and, finally, 18 court rulings and 52 injunction orders were issued in Sweden.

Fifthly, regarding the calculation of the fine, the Court confirms that the Commission was correct in finding the infringement to be serious, even if it was unintentional. Similarly, the Court considers that the fact that the concentration transaction had no effect on the market is not a decisive factor for determining the gravity of the infringement in ex post facto merger control, and notes that the infringement lasted for a significant time. The Court also considers that the Commission was correct in finding that the fact that the infringement was committed through negligence need not give rise to a reduction in the fine. Regarding the proportionality of the amount of the fine, the Court notes, in particular, in addition to the characteristics of the infringement, first, that the amount of the fine, although high, is at the lower end of the range of amounts that could have been imposed and, secondly, that it does not seem disproportionate in relation to the objective pursued of protection of the system of notification and prior approval of concentrations.

Moreover, if the fact of already having had a fine imposed were to justify the reduction of a subsequent fine, that would lead to the paradoxical situation where an undertaking could multiply its participation in cartels and see the cost of each fine diminish progressively, which would clearly be contrary to the objective of deterrence pursued by the fines.
