4 (1) The bridge and tunnel described in sections 2 and 3 respectively and the works ancillary thereto shall be constructed and maintained in accordance with and subject to such regulations for the safeguarding of navigation of the St. Lawrence River as the Governor in Council may prescribe, and, for that purpose, the Province shall, prior to the commencement of construction of the bridge, tunnel or ancillary works, submit to the Governor in Council for examination and approval plans and drawings thereof and a map of their proposed locations, indicating accurately all relevant soundings and showing the bed of the stream and the location of all other bridges in the area, and furnish to the Governor in Council such other information as is required for a full and satisfactory understanding of the project.
4 (1) Le pont et le tunnel désignés aux articles 2 et 3 respectivement et les ouvrages y accessoires doivent être construits et entretenus en conformité et sous réserve de tels règlements, pour la sauvegarde de la navigation sur le fleuve Saint-Laurent, que le gouverneur en conseil peut prescrire, et, à cette fin, la province doit, antérieurement au début de la construction du pont, du tunnel ou des ouvrages accessoires, soumettre à l’examen et à l’approbation du gouverneur en conseil des plans et dessins y relatifs et une carte de leurs emplacements projetés, donnant exactement les sondages pertinents et indiquant le lit du cours d’eau et l’emplacement de tous les autres ponts de la région. (2) Construction of the bridge shall not be commenced until such time as the plans and drawings referred to in subsection (1) and the location of the bridge have been approved by the Governor in Council, and no material change in such plans or drawings, or in the location of the bridge, shall be made after the commencement of construction of the bridge except with the prior approval of the Governor in Council.

5. Where available in Canada, Canadian labour and materials, to the extent of 50%, as nearly as may be, of the cost of such labour and materials respectively, shall be employed in the construction of the bridge, and construction of the bridge shall not be commenced until such time as evidence satisfactory to the Minister of Labour has been submitted to him by the Province that the arrangements for the construction of the bridge are such as to ensure effective compliance with the requirements of this section.
5. 5. The prohibitions in paragraphs 1 and 3 shall not apply to the execution, until 28 October 2014 of transactions required by a trade contract concluded before30 July 2014 concerning key equipment or technology as listed in Annex III or by ancillary contracts necessary for the execution of such contracts provided that the natural or legal person, entity or body seeking to engage in such transactions, or to provide assistance to such transactions, has notified, at least 10 working days in advance, the transaction or assistance to the competent authority of the Member State in which it is established.

Les interdictions figurant aux paragraphes 1 et 3 ne s'appliquent pas à l'exécution, jusqu'au 28 octobre 2014, des opérations requises par un accord commercial conclu avant le 30 juillet 2014 portant sur des équipements ou technologies essentiels, tels qu'énumérés à l'annexe III, ou par des contrats accessoires nécessaires à l'exécution de ces contrats, pour autant que la personne physique ou morale, l'entité ou l'organisme souhaitant se livrer à de telles opérations, ou fournir une assistance dans le cadre de ces opérations, ait notifié, au moins dix jours ouvrables à l'avance, l'opération ou l'assistance à l'autorité compétente de l'État membre sur le territoire duquel il ou elle est établi(e).

(4) The capital cost, assessed pursuant to subsection (2), may be made payable in annual instalments, extending over such period of years, and in such respective amounts for any stated years, as the Minister may determine; and the Minister may provide, if any water-power sites mentioned in subsection (2) are undeveloped or have not commenced to be operated at the time when the regulating or storage works are undertaken, that the commencement of payment of the annual instalments may in such cases be deferred until development and operation take place, or until such time has elapsed thereafter as the Minister may deem suitable.

The prohibitions in paragraphs 1 and 2 shall be without prejudice to the execution until 21 March 2015 of an obligation arising from a contract or an ancillary contract concluded before 20 December 2014, or ◄ ancillary contracts necessary for the execution of such contracts, provided that the competent authority has been informed at least five working days in advance.

Provided that such works are ancillary with respect to the main object of the contract and are consequential or complementary thereto, the fact that such works form part of the contract shall not justify the contract in question being categorised as a public works contract.
