National type-approval authorities have the obligation to certify that a vehicle meets all EU safety, environmental and production requirements – including those on mobile air-conditioning systems – before authorising it to be placed on the EU market.

If the approval authority granting whole vehicle type-approval is not satisfied with the reported information referred to in point 2.4 and has communicated this in writing to the manufacturer in question and the approval authority granting type-approval for the system, component or separate technical unit, the approval authority granting whole vehicle type-approval shall demand additional conformity of production audits or checks to be performed at the site of the manufacturer(s) of those systems, components or separate technical units and the results shall immediately be made available to the approval authority concerned.

Furthermore, in May 2013, the German approval authorities accepted the request from the manufacturer to discontinue the use of current type approvals for those vehicles and to extend instead old vehicle approvals for these same vehicles.

However, the German approval authorities opted not to react and did not impose adequate remedial measures on the concerned manufacturer.
