12. Recalls the need for greater convergence between national defence planning processes and welcomes, in this context, the adoption by the Council of the Policy Framework for Systematic and Long-Term Defence Cooperation; finds regrettable, however, its non-binding nature and the fact that it has not introduced a clear and structured process; underlines that this document should be welcomed by the European Council in order to become a key driver; encourages Member States to request the support of the EDA in their national defence reviews and to share information on national investment plans and priorities inside the EU Military Committee; calls on the Member States to launch permanent structured cooperation (PESCO) as means for better coordination and to use EU financing for peacetime cooperation; calls on the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy (VP/HR) to deliver realistic plans for the successful launch of PESCO;

Without prejudice to Member States’ sovereignty over the airspace and to the requirements of the Member States relating to public order, public security and defence matters, the Network Manager, Member States, third countries, airspace users, functional airspace blocks and air navigation service providers as part of functional airspace blocks or individually shall develop, using a cooperative decision-making process, the European Route Network Improvement Plan, while applying the airspace design principles set out in this Annex.
Onverminderd de soevereiniteit van de lidstaten over het luchtruim en de eisen inzake openbare orde, openbare veiligheid en defensie, stellen de netwerkbeheerder, de lidstaten, derde landen, de luchtruimgebruikers, de functionele luchtruimblokken en de verleners van luchtvaartnavigatiediensten, als onderdeel van functionele luchtruimblokken of individueel, het plan voor de verbetering van het Europese routenetwerk op, waarbij zij gebruikmaken van een proces van coöperatieve besluitvorming en de in deze bijlage vermelde beginselen inzake luchtruimontwerp toepassen.

15. Considers it regrettable that past efforts to consolidate demand have not improved the fragmentation of demand in the EU, with 28 national defence customers and an even higher number of customers of products for civilian and military use; regrets the limited results of the EDA’s Capability Development Plan; calls, therefore, on the European Council to launch a European defence review process and make the coordination of national defence planning processes at EU level a reality; based on this assessment, calls on the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy to initiate a wide-ranging process to develop a White Paper on European Security and Defence in order to streamline the EU’s strategic ambitions and capability development processes;

Reiterates its call for the systematic harmonisation of military requirements and for a harmonised EU defence planning and acquisition process, matching up to the Union’s level of ambition and coordinated with the NATO Defence Planning Process; taking into account the increased level of security guarantees provided by the mutual defence clause, encourages the Member States to consider multinational cooperation in the area of capability development, and, where appropriate, specialisation, as core principles of their defence planning;
16. dringt andermaal aan op systematische harmonisatie van militaire vereisten en een geharmoniseerd defensieplannings- en aanschafproces in de EU, met inachtneming van de ambities van de Unie en afgestemd op het defensieplanningsproces van de NAVO; spoort de lidstaten in het licht van een hoger niveau van veiligheidsgaranties door de clausule inzake wederzijdse verdediging aan multinationale samenwerking op het gebied van capaciteitsopbouw en, waar zulks zinvol is, specialisatie als grondbeginselen van hun defensieplanning in overweging te nemen;

In accordance with the EU Strategic Framework and Action Plan on Human Rights and Democracy, the Commission shall develop operational guidance to ensure that human rights are taken into consideration in the design and implementation of the measures referred to in paragraph 1, in particular as regards the prevention of torture and other cruel, inhuman or degrading treatment and respect for due process, including the presumption of innocence, the right to a fair trial and rights of defence.
2. In overeenstemming met het strategisch kader en het actieplan van de EU inzake mensenrechten en democratie ontwikkelt de Commissie operationele richtsnoeren opdat bij de planning en uitvoering van de in lid 1 bedoelde maatregelen rekening wordt gehouden met mensenrechten, met name op het vlak van de voorkoming van foltering en andere wrede, onmenselijke of vernederende behandeling en van de eerbiediging van een deugdelijke procesvoering, zoals het vermoeden van onschuld, het recht op een eerlijk proces en de rechten van de verdediging.

The EU Strategic Framework and Action Plan on Human Rights and Democracy, adopted by the Council on 25 June 2012, calls for the development of operational guidance to ensure that human rights are taken into consideration in the design and implementation of counter-terrorism assistance measures, and underlines that the eradication of torture and other cruel, inhuman or degrading treatment and respect for due process (including the presumption of innocence, the right to a fair trial and rights of defence) are a Union priority in the implementation of human rights.

It contributes to the process of elaboration, assessment and review of the capability goals, taking into account the need, for those Member States concerned, to ensure consistency with NATO's Defence Planning Process (DPP) and the Planning and Review Process (PARP) of the Partnership for Peace (PfP) in accordance with agreed procedures.
