1. This Regulation applies to the processing of personal data wholly or partly by automated means and to the processing other than by automated means of personal data which form part of a filing system or are intended to form part of a filing system.

1. This Regulation applies to the processing of personal data wholly or partly by automated means, and to the processing other than by automated means of personal data which form part of a filing system or are intended to form part of a filing system.

3. This Framework Decision shall apply to the processing of personal data wholly or partly by automatic means, and to the processing otherwise than by automatic means, of personal data which form part of a filing system or are intended to form part of a filing system.

‘personal data filing system’ and ‘filing system’ mean any structured set of personal data which are accessible according to specific criteria, whether centralised, decentralised or dispersed on a functional or geographical basis.

The Commission further notes that, in view of the purposes of this Directive, and in accordance with the requirements of Directive 95/46/EC, access to the centralised data filing system, or the system guaranteeing access to non-centralised filing systems, should only be available to police and judicial authorities for the prevention, investigation, detection and prosecution of criminal offences'.
Verder wijst de Commissie erop dat gezien de doelstellingen van deze richtlijn, alsook overeenkomstig de vereisten voortvloeiend uit Richtlijn 95/46/EG, enkel en alleen de politie en de juridische autoriteiten toegang verschaft zou mogen worden tot zowel de gecentraliseerde gegevensbank als het systeem dat toegang geeft tot niet-gecentraliseerde gegevensbanken, dit alles voor doeleinden van preventie, navorsing, opsporing en vervolging van misdrijven”.

53. Regrets the lack of a common understanding on geographical indications; regrets that the co-existence of fundamentally different patent systems (the US with its "first-to-invent" system whilst the "first-to-file" system is followed by the rest of the world) continues to create considerable problems for EU companies; encourages the US Congress to pursue the reform of the patent system by moving toward a "first-to-file" system;

50. (c) "personal data filing system" hereinafter referred to as "filing system" shall mean any structured set of personal data which are accessible according to specific criteria, whether centralised, decentralised or dispersed on a functional or geographical basis.
