As regards the choice between India and the USA, the Commission selected India on the following grounds: there were more than 20 known domestic producers in India, and hence the prices in the Indian market were the result of genuine competition.

Onder andere is gedurende meer dan twee jaar de frequentie verhoogd van de officiële controles van de invoer van grondnoten uit India op aflatoxinen, kerrieblad uit India op residuen van bestrijdingsmiddelen, grondnoten uit Ghana op aflatoxinen en zaden van watermeloenen uit Nigeria op aflatoxinen, en gedurende bijna twee jaar van okra’s uit India op residuen van bestrijdingsmiddelen.

In order to ensure an efficient organisation and ensure a degree of uniformity at the Union level of the controls at import, it is appropriate to provide in this Regulation measures which are equivalent to the existing measures as provided for in Regulation (EC) No 669/2009 for the physical control on pesticide residues on curry leaves and okra from India and Commission Regulation (EC) No 1152/2009 of 27 November 2009 imposing special conditions governing the import of certain foodstuffs from certain third countries due to contamination risk by aflatoxins and repealing Decision 2006/504/EC (10) for the control of aflatoxins in groundnuts from India and Ghana and watermelon seeds from Nigeria.
Voor een efficiënte organisatie en een zekere mate van harmonisatie op Unieniveau van de invoercontroles, is het gewenst om in deze verordening maatregelen vast te stellen die gelijkwaardig zijn aan de bestaande maatregelen als vastgelegd in Verordening (EG) nr. 669/2009 van de Raad voor de fysieke controle op residuen van bestrijdingsmiddelen op kerrieblad en okra’s uit India en in Verordening (EG) nr. 1152/2009 van de Raad van 27 november 2009 tot vaststelling van bijzondere voorwaarden voor de invoer van bepaalde levensmiddelen uit bepaalde derde landen in verband met het risico van verontreiniging met aflatoxinen en tot intrekking van Beschikking 2006/504/EG (10) wat de controle op aflatoxinen in grondnoten uit India en Ghana en in zaden van watermeloenen uit Nigeria betreft.

All consignments of groundnuts from India and Ghana, watermelon seeds from Nigeria and curry leaves and okras from India should therefore be accompanied by a certificate stating that the products have been sampled and analysed for the presence of, according to the case, aflatoxins or pesticide residues and have been found compliant with Union legislation.
Alle zendingen van grondnoten uit India en Ghana, zaden van watermeloenen uit Nigeria en kerrieblad en okra’s uit India moeten derhalve vergezeld gaan van een certificaat waarin wordt verklaard dat de producten zijn bemonsterd en geanalyseerd op de aanwezigheid van, naar gelang van het geval, aflatoxinen of residuen van bestrijdingsmiddelen en dat zij aan de wetgeving van de Unie voldoen.

Commission Decision 2010/381/EU of 8 July 2010 on emergency measures applicable to consignments of aquaculture products imported from India and intended for human consumption (3) provides that at least 20 % of the consignments of aquaculture products from India intended for human consumption are to be tested for the presence of pharmacologically active substances as defined in Article 2(a) of Regulation (EC) No 470/2009 of the European Parliament and of the Council (4), and in particular of chloramphenicol, tetracycline, oxytetracycline and chlortetracycline and of metabolites of nitrofurans.

Further, significant barriers to trade in services exist in many sectors and many partner countries of interest to European business like for legal services, for instance, in India, China and Singapore, distribution services in India, China and ASEAN countries, postal and courier services in India, Brazil, China and Egypt, transport services in Brazil and India as well as in Canada, South Africa and Singapore, while barriers to telecommunication services exist in China, Korea, Japan, India, Mexico and, to a lesser extent, Brazil.

Pursuant to Article 1(1) of Protocol 3 on ACP sugar (hereinafter referred to as the ACP Protocol) attached to Annex V to the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 (hereinafter referred to as the ACP-EC Partnership Agreement), and Article 1(1) of the Agreement between the European Economic Community and the Republic of India on cane sugar (hereinafter referred to as the Agreement with India), the Community undertakes to purchase and import, at guaranteed prices, specific quantities of cane sugar which originate in the ACP States and India respectively and which those States undertake to deliver to it.
Bij artikel 1, lid 1, van Protocol nr. 3 betreffende ACS-suiker (hierna „het ACS-protocol” genoemd), dat is gehecht aan bijlage V van de Partnerschapsovereenkomst tussen de leden van de groep van Staten in Afrika, het Caribische gebied en de Stille Oceaan, enerzijds, en de Europese Gemeenschap en haar lidstaten, anderzijds, ondertekend te Cotonou op 23 juni 2000 (hierna „de ACS-EG-partnerschapsovereenkomst” genoemd), en bij artikel 1, lid 1, van de Overeenkomst tussen de Europese Economische Gemeenschap en de Republiek India over rietsuiker (hierna „de overeenkomst met India” genoemd) is vastgesteld dat de Gemeenschap zich ertoe verbindt tegen gegarandeerde prijzen bepaalde hoeveelheden rietsuiker van oorsprong uit de ACS-staten, respectievelijk uit India, tot levering waarvan deze staten zich verbinden, te kopen en in te voeren.
