Properly structured and consistent administrative procedures support both an efficient administration and a proper enforcement of the right to good administration guaranteed as a general principle of Union law and under Article 41 of the Charter.

‘administrative activities’ means those carried out by the Union’s administration for the implementation of Union law, with the exception of the procedures referred to Article 2(2).

Regulation (EU) No 1024/2013 vested the ECB with some supervisory tasks and entitled the latter to impose on the credit institutions it supervises: (a) administrative pecuniary penalties when these institutions breach a requirement under directly applicable Union law in relation to which administrative pecuniary sanctions shall be made available to competent authorities under the relevant Union law; and (b) sanctions in accordance with Regulation (EC) No 2532/98 in case of a breach of ECB regulations or decisions (hereinafter jointly referred to as ‘administrative penalties’).

Fiscalis 2020 should cover bilateral or multilateral controls and other forms of administrative cooperation as established in the relevant Union law on administrative cooperation; expert teams; public administration capacity–building actions providing specific and specialised coaching in the field of taxation to Member States facing particular and exceptional circumstances that justify such targeted actions; and, where necessary, studies and common communication activities in order to support the implementation of Union law in the field of taxation.

For the purpose of carrying out the tasks conferred on it by this Regulation, where credit institutions, financial holding companies, or mixed financial holding companies, intentionally or negligently, breach a requirement under relevant directly applicable acts of Union law in relation to which administrative pecuniary penalties shall be made available to competent authorities under the relevant Union law, the ECB may impose administrative pecuniary penalties of up to twice the amount of the profits gained or losses avoided because of the breach where those can be determined, or up to 10 % of the total annual turnover, as defined in relevant Union law, of a legal person in the preceding business year or such other pecuniary penalties as may be provided for in relevant Union law.
1. Met het oog op de uitoefening van de haar bij deze verordening opgedragen taken kan de ECB, indien kredietinstellingen, financiële holdings of gemengde financiële holdings opzettelijk of uit onachtzaamheid een inbreuk plegen op een krachtens relevante rechtstreeks toepasselijke handelingen van het Unierecht geldend voorschrift waarvoor administratieve geldelijke sancties aan de bevoegde autoriteiten beschikbaar gesteld moeten worden krachtens het toepasselijke Unierecht, administratieve geldelijke sancties opleggen van maximaal tweemaal het bedrag van de als gevolg van de inbreuk behaalde winsten of vermeden verliezen ingeval deze kunnen worden bepaald, of maximaal 10 % van de totale jaaromzet, als bepaald in het toepasselijke Unierecht, van een rechtspersoon in het voorgaande boekjaar, of andere geldelijke sancties waarin het toepasselijke Unierecht voorziet.

Administrative decisions shall clearly state – where Union law so provides – that an appeal is possible, and shall describe the procedure to be followed for the submission of such appeal, as well as the name and office address of the person or department with whom the appeal must be lodged and the deadline for lodging it.
In een administratief besluit wordt duidelijk vermeld dat beroep tegen het besluit kan worden ingesteld – voorzover het Unierecht daarin voorziet – , met beschrijving van de te volgen procedure voor indiening van dat beroep , alsmede van de naam en het kantooradres van de persoon of afdeling waaraan het beroepmoet worden gericht en de daarvoor geldende termijn.

4. Notes that the infringement procedure consists of two phases: the administrative (investigation) stage and the judicial stage before the Court of Justice; considers that the role of citizens as complainants is vital in the administrative phase when it comes to ensuring compliance with Union law on the ground, which is again acknowledged by the Commission in its above-mentioned Communication of 20 March 2002; considers it therefore of paramount importance to guarantee transparency, fairness and reliability of the procedures that empower citizens to detect infringements of Union law and to bring these to the Commission’s attention;
4. merkt op dat een inbreukprocedure uit twee fasen bestaat: een bestuursrechterlijke (onderzoeks)fase en een gerechtelijke fase bij het Hof van Justitie; is van mening dat de rol van de burgers als klagers tijdens de bestuursrechtelijke fase van wezenlijk belang is met het oog op de naleving van het recht van de Unie in de maatschappij, hetgeen de Commissie in haar bovengenoemde mededeling van 20 maart 2002 opnieuw erkent; is dan ook van oordeel dat het uiterst belangrijk is dat wordt gewaarborgd dat de procedures die de burgers in staat stellen inbreuken op het recht van de Unie op te sporen en deze onder de aandacht van de Commissie te brengen, transparant, eerlijk en betrouwbaar zijn;

(b)by providing, upon request and without prejudice to national and Union law, relevant vessel positioning and Earth observation data to the competent national authorities and relevant Union bodies within their mandate in order to facilitate measures against threats of piracy and of intentional unlawful acts as provided for in applicable Union law or under internationally agreed legal instruments in the area of maritime transport, subject to applicable data protection rules and in accordance with administrative procedures to be established by the Administrative Board or the High Level Steering Group established in accordance with Directive 2002/59/EC, as appropriate.
b)door, op verzoek en onverminderd het nationale en uniaal recht, toepasselijke gegevens over de positionering van vaartuigen en aardeobservatiegegevens te verstrekken aan de bevoegde nationale instanties en de betrokken organen van de Unie, binnen de grenzen van hun mandaat, teneinde maatregelen tegen dreigingen van piraterij en van opzettelijke onwettige handelingen te bevorderen, overeenkomstig de bepalingen in het toepasselijke uniaal recht of uit hoofde van op internationaal niveau overeengekomen rechtsinstrumenten op het gebied van zeeverkeer.
