The Return Directive also clearly states the obligation to respect the principle of non-refoulement (meaning no state shall expel or return ('refouler') a refugee to the frontiers of territories where his life or freedom would be threatened on account of his race, religion, nationality, membership of a particular social group or political opinion).

As part of this Partnership, Tunisia and the EU will also work together to support the establishment and strengthening of the Tunisian authorities that will be responsible for identifying those migrants on their territory who are eligible for international protection, processing their asylum applications, applying the principle of ‘non-refoulement’ to them and providing them with lasting protection arrangements.

The European Council, at its special meeting in Tampere on 15 and 16 October 1999, agreed to work towards establishing a Common European Asylum System, based on the full and inclusive application of the Geneva Convention relating to the Status of Refugees of 28 July 1951, as supplemented by the New York Protocol of 31 January 1967, thus ensuring that nobody is sent back to persecution, i.e. maintaining the principle of non-refoulement. In this respect, and without affecting the responsibility criteria laid down in this Regulation, Member States, all respecting the principle of non-refoulement, are considered as safe countries for third-country nationals.
3. This Regulation respects the fundamental rights and observes the principles recognised in particular by the TFEU and the Charter of Fundamental Rights, notably the right to human dignity, the prohibition of torture and of inhuman or degrading treatment or punishment, the right to liberty and security, the right to protection of personal data, the right to asylum, the principle of non-refoulement, the principle of non-discrimination, the rights of the child, and the right to an effective remedy.

shares the Commission's assessment that there is a need for a comprehensive and integrated approach to migration in the Mediterranean which encompasses dialogue and cooperation with Libya, other Mediterranean partners and main African countries of origin and transit, in full compliance with the objectives of the strategic framework established by the European Neighbourhood Policy referred to in the Hague Programme for the external dimension of asylum and migration; underlines that cooperation between the EU and third countries is guided by the principles of full respect for human rights, respect for democratic principles, the rule of law and the demonstration by those countries of a genuine commitment to fulfil their obligations under the Geneva Convention on Refugees or other relevant international conventions; calls on the Libyan authorities to demonstrate a genuine commitment to fulfil their obligations under the OAU Convention Governing the Specific Aspects of Refugee Problems in Africa which recognises that the Geneva Convention on Refugees constitutes the basic and universal instrument relating to the status of refugees and which requires effective cooperation with the UNHCR and the respect of the principle of 'non-refoulement'.
