The Statistical Programme Committee (SPC) referred to in Article 3(2) of this Agreement has been replaced by the European Statistical System Committee (ESS Committee) established by Article 7(1) of Regulation (EC) No 223/2009 of the European Parliament and of the Council of 11 March 2009 on European statistics and repealing Regulation (EC, Euratom) No 1101/2008 of the European Parliament and of the Council on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities, Council Regulation (EC) No 322/97 on Community Statistics, and Council Decision 89/382/EEC, Euratom establishing a Committee on the Statistical Programmes of the European Communities (1).

The regulation sets a deadline of 2-year prior to the expiry of a supplementary protection certificate (SPC – in effect a patent extension) for submission of an application to prolong the SPC by 6-months (the reward for conducting studies in children).

I have closely reviewed the discussions and debates on how best to achieve this and I can support the Commission’s proposal regarding the SPC extension, in tandem with the review mechanism proposed in the Regulation.

The reward takes the form of a 6-month extension of the supplementary protection certificate (SPC) provided for by Regulation (EC) No 469/2009[17] or, in the case of an orphan medicinal product, by an extension of the ten-year period of orphan market exclusivity to twelve years.

The legislative context for this is covered by both the Council Decision setting up the SPC (89/382/EEC, Euratom) and the Council Regulation on Community statistics (EC) No 322/97 supported by the Commission Decision on the role of Eurostat as regards the production of Community statistics (97/281/EC) to ensure a coordinated approach on statistical information across all Commission services.

For activities within this priority framework, the detailed range and extent of data collected will in general continue to be elaborated by Eurostat with the Member States in the context of the Statistical Programme Committee (SPC) and the Committee on Monetary, Financial and Balance of Payment Statistics (CMFB) according to the rules defined in the Council Regulation on Community statistics and in conformity with agreed principles for such decisions concerning work management.

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Statistical Programme Committee (SPC), established by Council Decision 89/382/EEC, Euratom (2);

(19) Whereas it is necessary to set up a procedure to adapt and update the provisions of this Regulation in cooperation with the Statistical Programme Committee of the European Community (SPC), established by Council Decision 89/382/EEC, Euratom (5); whereas that adaptation procedure will be limited to amendments which do not increase own resources;
