Any product that is protected by a national patent and subject to national authorisation before it may be sold, and does not already have a certificate, may receive a supplementary protection certificate (SPC)*

In this regard, the Commission intends to come forward with a proposal for the creation of a Community supplementary protection certificate extending the protection conferred by Community patents in the way as is the case for national patents under Council regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products [OJ L 182, 2.7.1992, pp. 1-5] and regulation (EC) No 1610/96 of the European Parliament and the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products [OJ L 198, 8.8.1996, pp. 30-35].
In dit verband beoogt de Commissie een voorstel voor de invoering van een communautair aanvullend beschermingscertificaat, waarbij de door het Gemeenschapsoctrooi geboden bescherming op dezelfde wijze wordt uitgebreid als Verordening (EG) nr. 1768/92 van 18 juni 1992 betreffende de invoering van een aanvullend beschermingscertificaat voor geneesmiddelen [PB L 182 van 2.7.1992, blz. 1 en 5] en Verordening (EG) nr. 1610/96 van het Europees Parlement en de Raad van 23 juli 1996 betreffende de invoering van een aanvullend beschermingscertificaat voor gewasbeschermingsmiddelen [PB L 198 van 8.8.1996, blz. 30 en 35] doen voor nationale octrooien.

U. whereas, in particular, enhanced cooperation in this area complies with the Treaties and Union law since it will not affect the acquis , given that, to date, only a limited number of legal acts of the Union within the meaning of Article 288 TFEU have been adopted, none of them covering the creation of a European intellectual property right providing for uniform protection throughout the Union; whereas, with the exception of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions , no approximation of substantive patent law exists at Union level, and whereas Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products and Regulation (EC) No 469/2009 of the European Parliament and of the Council of 6 May 2009 concerning the supplementary protection certificate for medicinal products concern patent term extensions for specific types of patented subject matter; whereas enhanced cooperation in the area of patents would not cause discrimination since access to the unitary patent will be open to users of the patent system from all over the Union,
U. overwegende met name dat nauwere samenwerking op dit gebied in overeenstemming is met de Verdragen en het EU-recht aangezien het geen gevolgen heeft voor het acquis , omdat er tot dusver slechts een beperkt aantal rechtshandelingen van de Unie in de zin van artikel 288 VWEU zijn goedgekeurd, waarvan er geen enkele betrekking heeft op de instelling van een Europees intellectueel eigendomsrecht dat voorziet in uniforme bescherming in de hele Unie; overwegende dat, met uitzondering van Richtlijn 98/44/EG van het Europees Parlement en de Raad van 6 juli 1998 betreffende de rechtsbescherming van biotechnologische uitvindingen er geen onderlinge aanpassing van materieel octrooirecht op het niveau van de Unie bestaat en overwegende dat Verordening (EG) nr. 1610/96 van het Europees Parlement en de Raad van 23 juli 1996 betreffende de invoering van een aanvullend beschermingscertificaat voor gewasbeschermingsmiddelen en Verordening (EG) nr. 469/2009 van het Europees Parlement en de Raad van 6 mei 2009 betreffende het aanvullende beschermingscertificaat voor geneesmiddelen betrekking hebben op verlengingen van de octrooiduur voor specifieke soorten geoctrooieerde onderwerpen; overwegende dat nauwere samenwerking op het gebied van octrooien geen discriminatie zal veroorzaken, aangezien toegang tot het eenheidsoctrooi zal openstaan voor de gebruikers van het octrooistelsel uit de hele Unie,

"paediatric use marketing authorisation" means a marketing authorisation granted in respect of a medicinal product for human use which is not protected by a supplementary protection certificate under Regulation (EEC) No 1768/92 or by a patent which qualifies for the granting of the supplementary protection certificate, covering exclusively therapeutic indications which are relevant for use in the paediatric population, or subsets thereof, including the appropriate strength, pharmaceutical form or route of administration for that product.
