Op grond van artikel 18, lid 2, van richtlijn 2010/24 is de aangezochte autoriteit er niet toe verplicht de in artikel 5 en de artikelen 7 tot en met 16 bedoelde bijstand te verlenen „indien het initiële verzoek om bijstand krachtens artikel 5, 7, 8, 10 of 16 betrekking heeft op schuldvorderingen die meer dan vijf jaar oud zijn, te rekenen vanaf de datum waarop de schuldvordering in de verzoekende lidstaat opeisbaar is geworden tot de datum van het initiële verzoek om bijstand”.
Article 18(2) of Directive 2010/24 excuses the requested authority from providing the forms of assistance set out in Articles 5 and 7 to 16, ‘if the initial request for assistance pursuant to Articles 5, 7, 8, 10 or 16 is made in respect of claims which are more than 5 years old, dating from the due date of the claim in the applicant Member State to the date of the initial request for assistance’.

5. The assistance and support measures referred to in paragraphs 1 and 2 shall be provided on a consensual and informed basis, and shall include at least standards of living capable of ensuring victims’ subsistence through measures such as the provision of appropriate and safe accommodation and material assistance, as well as necessary medical treatment including psychological assistance, counselling and information, and translation and interpretation services where appropriate.
