‘family benefit’ means all benefits in kind or in cash intended to meet family expenses, excluding advances of maintenance payments and special childbirth and adoption allowances mentioned in Annex I.

Uit de arresten van het Hof van Justitie komt naar voren dat de betreffende uitkeringen aan twee belangrijke criteria moeten beantwoorden om als niet-exporteerbaar te worden beschouwd en daarmee afwijken van het algemene beginsel dat sociale uitkeringen exporteerbaar zijn: het moet gaan om een bijzondere uitkering in de betreffende staat - mensen ontvangen deze uitkering zonder hiervoor premie te hebben betaald -, ofwel het is een uitkering die een onderdeel vormt van het algemene belastingstelsel van de betreffende staat en uit dat stelsel wordt gefinancierd. Een bijkomend punt ten slotte is dat de hoogte afhankelijk dient te zijn van het minimum bestaansniveau in de economische context van het land dat de uitkering toekent.
The decisions of the Court of Justice have made it possible to single out two essential characteristics which these benefits must exhibit in order to be considered as non-exportable and, therefore, to enjoy derogations from the general principle of the exportability of social benefits: their special character in the Member State concerned; the fact that the beneficiary does not contribute to them, in other words that they are funded from, and on the basis of, general taxation in the Member State concerned; and, finally – and as a supplementary factor – the fact that the amount is in line with the minimum necessary income required to live in the economic environment of the country granting the benefits.
