It is necessary to prohibit all audiovisual commercial communication promoting cigarettes and other tobacco products including indirect forms of audiovisual commercial communication which, whilst not directly mentioning the tobacco product, seek to circumvent the ban on audiovisual commercial communication for cigarettes and other tobacco products by using brand names, symbols or other distinctive features of tobacco products or of undertakings whose known or main activities include the production or sale of such products.

It is necessary to put an end to total prohibitions on commercial communications by the regulated professions, not by removing bans on the content of a commercial communication but rather by removing those bans which, in a general way and for a given profession, forbid one or more forms of commercial communication, such as a ban on all advertising in one or more given media.

Overeenkomstig het evenredigheidsbeginsel en het beleid van de Commissie inzake commerciële communicatie, waarin via de werkzaamheden van de deskundigengroep voor commerciële communicatie is getracht dit beginsel zo transparant en precies mogelijk toe te passen, gaan de in deze verordening beoogde maatregelen niet verder dan hetgeen nodig is om de doelstelling van de goede werking van de interne markt te verwezenlijken. Daar waar optreden op communautair niveau noodzakelijk is en om erop toe te zien dat op het gebied van de commerciële communicatie een ware ruimte zonder binnengrenzen bestaat, dient de verordening een hoog beschermingsniveau te garanderen voor doelstellingen van algemeen belang, in het bijzonder voor de bescherming van minderjarigen, consumenten en in die context ook van eerlijke handelspraktijken en de volksgezondheid.
In accordance with the principle of proportionality and the Commission's policy on commercial communications, which through the work of the Expert Group on commercial communications, has sought to apply this principle in as transparent and precise a manner as possible, the measures provided for in this Regulation are strictly limited to the minimum needed to achieve the objective of the proper functioning of the internal market; where action at Community level is necessary, and in order to guarantee an area which is truly without internal frontiers as far as sales promotions are concerned, the Regulation must ensure a high level of protection of objectives of general interest, in particular the protection of minors, consumer protection and in that context fair trading and the protection of public health.

(29) Commerciële communicatie is essentieel voor de financiering van de diensten van de informatiemaatschappij en de ontwikkeling van een breed assortiment van nieuwe gratis diensten. Commerciële communicatie, met inbegrip van kortingen, promotionele aanbiedingen en spelen, dient in het belang van de consument en met het oog op de eerlijkheid van de transacties aan een aantal voorschriften inzake transparantie te voldoen. Deze voorschriften laten Richtlijn 97/7/EG onverlet. Deze richtlijn doet geen afbreuk aan de bestaande richtlijnen over commerciële communicatie, met name Richtlijn 98/43/EG.
(29) Commercial communications are essential for the financing of information society services and for developing a wide variety of new, charge-free services; in the interests of consumer protection and fair trading, commercial communications, including discounts, promotional offers and promotional competitions or games, must meet a number of transparency requirements; these requirements are without prejudice to Directive 97/7/EC; this Directive should not affect existing Directives on commercial communications, in particular Directive 98/43/EC.

(30) De toezending van ongevraagde commerciële communicatie via elektronische post kan voor consumenten en verleners van diensten van de informatiemaatschappij niet gewenst zijn en kan de soepele functionering van interactieve netwerken ontregelen. Het probleem van de instemming van ontvangers van sommige soorten van ongevraagde commerciële communicatie wordt niet behandeld in deze richtlijn, maar is reeds behandeld in Richtlijn 97/7/EG en Richtlijn 97/66/EG. In lidstaten die ongevraagde commerciële communicatie via elektronische post toestaan, moeten initiatieven van de bedrijfstak om goede filters aan te brengen, worden aangemoedigd en vergemakkelijkt. Ongevraagde commerciële communicatie moet in ieder geval duidelijk als zodanig kunnen worden geïdentificeerd om de doorzichtigheid te verbeteren en de functionering van dergelijke initiatieven van de bedrijfstak te vergemakkelijken.
(30) The sending of unsolicited commercial communications by electronic mail may be undesirable for consumers and information society service providers and may disrupt the smooth functioning of interactive networks; the question of consent by recipient of certain forms of unsolicited commercial communications is not addressed by this Directive, but has already been addressed, in particular, by Directive 97/7/EC and by Directive 97/66/EC; in Member States which authorise unsolicited commercial communications by electronic mail, the setting up of appropriate industry filtering initiatives should be encouraged and facilitated; in addition it is necessary that in any event unsolicited commercial communities are clearly identifiable as such in order to improve transparency and to facilitate the functioning of such industry initiatives; unsolicited commercial communications by electronic mail should not result in additional communication costs for the recipient.
