K. overwegende dat de beëindiging van het EGKS-Verdrag op 23 juli 2002 automatisch heeft geleid tot het verdwijnen van de rechtsvorm en de procedures van de EGKS, alsook tot ontbinding van het krachtens het EGKS-Verdrag opgerichte Raadgevend Comité,
K. whereas the expiry of the ECSC Treaty on 23 July 2002 entailed the complete disappearance of the ECSC's legal regime and the dissolution of the Consultative Committee set up by that Treaty,

– gezien Besluit 2002/234/EGKS van de vertegenwoordigers van de regeringen der lidstaten, in het kader van de Raad bijeen, van 27 februari 2002 betreffende de financiële gevolgen van de beëindiging van het EGKS-Verdrag en betreffende het Fonds voor onderzoek inzake kolen en staal , om het beheer van de "EGKS in vereffening" tot de inwerkingtreding van het Verdrag van Nice te regelen, alsook gezien de daarbij afgegeven verklaringen van de Commissie en de vertegenwoordigers van de regeringen der lidstaten, in het kader van de Raad bijeen,
– having regard to Decision 2002/234/ECSC of the representatives of the governments of the Member States, meeting within the Council, of 27 February 2002 on the financial consequences of the expiry of the ECSC Treaty and on the research fund for coal and steel , in order to govern the administration of the "ECSC in liquidation" pending the entry into force of the Treaty of Nice, and having regard to the statements made in connection therewith by the Commission and the Representatives of the Governments of the Member States, meeting within the Council,

De vertegenwoordigers van de regeringen van de lidstaten, in het kader van de Raad bijeen, hebben een besluit aangenomen over de gevolgen van het vervallen van het Verdrag tot oprichting van de Europese Gemeenschap voor Kolen en Staal (EGKS) voor door de EGKS gesloten internationale overeenkomsten (doc. 9403/02). Aangezien het EGKS-Verdrag op 23 juli 2002 vervalt en de door het EGKS-Verdrag bestreken aangelegenheden met ingang van 24 juli 2002 onder het Verdrag tot oprichting van de Europese Gemeenschap vallen, is besloten de rechten en verplichtingen uit hoofde van de door de EGKS gesloten internationale overeenkomsten over te dragen naar de Europese Gemeenschap.
Given that the ECSC Treaty expires on 23 July 2002 and that as from 24 July 2002 the Treaty's field of application will be covered by the Treaty establishing the European Community, it was decided that the rights and obligations arising under the international agreements concluded by the ECSC should be transferred to the European Community.

De overeenkomst werd ter verkrijging van een negatieve verklaring ingediend, zowel op grond van het Verdrag tot oprichting van de Europese Gemeenschap voor Kolen en Staal (EGKS-Verdrag) als van de EG-concentratieverordening, omdat de partijen zowel EGKS-producten vervaardigen als producten die buiten de bevoegdheidssfeer van het EGKS-Verdrag vallen en waarvoor dus het EG-Verdrag van toepassing is.
The deal was notified for clearance both under the ECSC Treaty (Treaty establishing the European Coal and Steel Community) and the EC Merger Regulation, since the parties produce products covered by the ECSC Treaty and products not falling under the jurisdiction of the said Treaty and therefore covered by the EC Treaty.

3. bekritiseert de Commissie voor het negeren van het standpunt van het Parlement dat de belangrijkste activiteiten van de EGKS, zoals de wederaanpassingssteun en de sociale maatregelen, geïntegreerd moeten worden in de algemene begroting van de Europese Unie; herinnert eraan dat na afloop van het EGKS-Verdrag binnen de Unie nog altijd 357 000 mensen werkzaam zijn in de sectoren kolen en staal; benadrukt dat deze werknemers na het verstrijken van het EGKS-Verdrag niet aan hun lot mogen worden overgelaten;
3. Criticises the Commission for ignoring Parliament's views, Parliament having called for crucial ECSC measures such as redeployment aid and social aid to be incorporated in the general budget of the EU; recalls that, as the ECSC ceases to exist, 357 000 people are still employed in the coal and steel industries within the Union; stresses that they must not be abandoned to their fate after the ECSC Treaty expires;

6. wijst erop dat in de sectoren kolen en staal in de Gemeenschap nog steeds naar schatting 280.000 mensen werkzaam zijn, en dat het belang van deze sectoren als gevolg van de uitbreiding zal toenemen; wijst erop dat het aflopen van het EGKS-Verdrag zal neerkomen op een dramatische daling van de steun die thans via de operationele begroting van het EGKS aan deze twee industrietakken wordt verleend; is van mening dat een geïntegreerde aanpak vereist dat alle aspecten van de sectoren kolen en staal (het sociale, economische en milieu-aspect) in aanmerking worden genomen en in de algemene begroting worden opgenomen, wanneer het EGKS-Verdrag afloopt;
6. Notes that the coal and steel sectors still employ an estimated 280,000 people in the Community, and that the importance of these sectors will increase as a result of enlargement; points out that the expiry of the ECSC Treaty will mean a dramatic drop compared to the current level of support provided to these two industries through the ECSC operating budget; considers that an integrated approach would require that all aspects of the coal and steel sectors (social, economic and environment) are taken into account and incorporated into the general budget once the ECSC Treaty comes to an end;

De overeenkomst werd ter verkrijging van een negatieve verklaring ingediend, zowel op grond van het EGKS-Verdrag (Verdrag tot oprichting van de Europese Gemeenschap voor Kolen en Staal) als van de EG-concentratieverordening, omdat de partijen producten vervaardigen die onder het EGKS-Verdrag vallen, naast producten die buiten de bevoegdheidssfeer van het EGKS-Verdrag vallen.
The deal was notified for clearance both under the ECSC Treaty (Treaty establishing the European Coal and Steel Community) and the EC Merger Regulation, because the parties produce products covered by the ECSC treaty and products not falling under the jurisdiction of the ECSC Treaty. The majority of the products for which the parties´ activities overlap fall to be investigated under the ECSC Treaty.

The European Commission today adopted a communication proposing the arrangements whereby, when the ECSC Treaty expires in 2002, the revenue yielded by the ECSC reserves will be used to finance research in the coal and steel industries.

De Raad heeft tevens, voor wat de Gemeenschap betreft, twee ontwerp-besluiten goedgekeurd die die Gemengde Comités moeten nemen (respectievelijk nr. 2/94 EG-Republiek Tsjechië en nr. 3/94 EG-Republiek Slowakije) tot wijziging van Besluit nr. 1/93 van 28 mei 1993 betreffende de invoer van bepaalde staalprodukten uit Tsjechië en Slowakije in de Gemeenschap. De Raad heeft ten slotte zijn instemming betuigd, uit hoofde van artikel 95 van het EGKS-Verdrag, met een ontwerp-beschikking van de Commissie tot wijziging van Beschikking nr. 1970/93/EGKS betreffende de opening en de wijze van beheer van tariefcontingenten voor bepaalde onder het EGKS-Verdrag vallende ijzer- en staalprodukten van oorsprong uit de Republiek Tsjechië en de Republiek Slowakije, die in de Gemeenschap worden ingevoerd (1 juni 1993 tot en met 31 december 1995).
The Council also approved, for the Community's part, two draft Decisions (No 2/94 of the EC-Czech Republic Joint Committee and No 3/94 of the EC- Slovak Republic Joint Committee) to be taken by the EC-Czech Republic and EC-Slovak Republic Joint Committees concerning modifications to Decision 1/93 of the EC-Czech and Slovak Republic, of 28 May 1993, concerning the export of certain steel products to the Community from the Czech Republic and from the Slovak Republic respectively In addition, the Council gave its assent pursuant to Article 95 of the ECSC Treaty on a draft Commission Decision amending Decision 1970/93/ECSC opening and providing for the administration of tariff quotas in respect of certain ECSC steel products originating in the Czech Republic and the Slovak Republic imported into the Community (1 June 1993 to 31 December 1995).
