De Commissie bestudeert deze evaluatie op grond van de beginselen die zijn vastgesteld in de handleiding voor kosten-batenanalyses[8]. Deze in 2003 gepubliceerde handleiding wordt thans bijgewerkt.

Na de door de Commissie verstrekte documenten te hebben onderzocht, heeft het Gerecht bij beschikking van 18 april 2013 besloten de algemene handleiding in het dossier op te nemen, de gedetailleerde handleiding terug te sturen naar de Commissie omdat die handleiding bij lezing ervan niet nodig bleek te zijn om te oordelen over de gegrondheid van de in de onderhavige zaak door verzoeker aangevoerde middelen, het vertrouwelijkheidsverzoek van de Commissie met betrekking tot het scoreprofiel te honoreren en het verstrekken aan verzoeker van de algemene handleiding en de niet-vertrouwelijke versie van het scoreprofiel afhankelijk te stellen van een aan voorwaarden verbonden vertrouwelijke behandeling.
After examining the documents supplied by the Commission, the Tribunal decided, by order of 18 April 2013, to place the general guide on the file and to send the detailed guide back to the Commission, on the ground that, having read the guide the Tribunal did not consider that this was necessary for it to rule on the merits of the pleas put forward by the applicant in the present case; to agree to the Commission’s request for confidentiality regarding the marking profile, and to make communication to the applicant of the general guide and the non-confidential version of the marking profile subject to confidential treatment and to certain conditions.

Bij brief, ter griffie van het Gerecht binnengekomen op 19 februari 2013, is de Commissie overgegaan tot toezending aan het Gerecht van een algemene handleiding met instructies voor beoordelaars, een gedetailleerde handleiding met instructies over de kern van de casestudy voor elk van de verschillende varianten, „juridisch handboek” geheten, en het scoreprofiel van de software die ter beschikking stond van de beoordelaars/juryleden om de vaardigheden van de kandidaten bij de casestudy te beoordelen.
By letter received by the Registry of the Tribunal on 19 February 2013, the Commission sent the Tribunal a general guide containing instructions for examiners, a detailed guide containing instructions regarding the substance of the case study for each of the different versions, entitled ‘legal manual’, and the marking profile in the software supplied to examiners/members of the selection board for assessing the competencies of the candidates during the case study.

Voorts mag overeenkomstig de Gemeenschappelijke Praktische Handleiding ten behoeve van eenieder die bij de opstelling van wetteksten is betrokken enkel worden verwezen naar een besluit dat "gepubliceerd is of voldoende toegankelijk is voor het publiek", wat niet het geval lijkt te zijn bij het migratieplan (zie punt 16.4 van de Gemeenschappelijke Praktische Handleiding).
In addition, according to the Joint Practical Guide for persons involved in the drafting of legislation reference should only be made to an act which "has been published or is sufficiently accessible to the public" which does not seem to be the case for the Migration Plan (see point 16.4 thereof).
