Commission Implementing Decision 2014/709/EU of 9 October 2014 concerning animal health control measures relating to African swine fever in certain Member States and repealing Implementing Decision 2014/178/EU (OJ L 295, 11.10.2014, p. 63).

1. is van mening dat het uitvoeringsbesluit van de Commissie niet in overeenstemming is met het recht van de Unie, omdat het niet verenigbaar is met het doel van Verordening (EG) nr. 1829/2003 en Verordening (EG) nr. 396/2005 van het Europees Parlement en de Raad, om overeenkomstig de algemene beginselen die in Verordening (EG) nr. 178/2002 van het Europees Parlement en de Raad zijn vastgesteld te voorzien in de grondslag voor een gegarandeerd hoog beschermingsniveau voor het leven en de gezondheid van de mens, de gezondheid en het welzijn van dieren, het milieu en de belangen van de consument met betrekking tot genetisch gemodificeerde levensmiddelen en diervoeders, waarbij de goede werking van de interne markt gewaarborgd is;
1. Considers that the draft Commission implementing decision is not consistent with Union law, in that it is not compatible with the aim of Regulation (EC) No 1829/2003 and Regulation (EC) No 396/2005 of the European Parliament and of the Council, which is, in accordance with the general principles laid down in Regulation (EC) No 178/2002 of the European Parliament and of the Council, to provide the basis for ensuring a high level of protection of human life and health, animal health and welfare, environment and consumer interests in relation to genetically modified food and feed, whilst ensuring the effective operation of the internal market;

– gezien het ontwerp van uitvoeringsbesluit van de Commissie tot verlening van een vergunning voor het in de handel brengen van producten die geheel of gedeeltelijk bestaan uit of zijn geproduceerd met genetisch gemodificeerde soja MON 87708 × MON 89788 (MON-877Ø8-9 × MON-89788-1) overeenkomstig Verordening (EG) nr. 1829/2003 van het Europees Parlement en de Raad,
– having regard to the draft Commission implementing decision authorising the placing on the market of products containing, consisting of, or produced from genetically modified soybean MON 87708 × MON 89788 (MON-877Ø8-9 × MON-89788-1) pursuant to Regulation (EC) No 1829/2003 of the European Parliament and of the Council,

C. overwegende dat het Permanent Comité op 18 november 2015 over het ontwerp van uitvoeringsbesluit van de Commissie heeft gestemd zonder een advies uit te brengen;
C. whereas the draft Commission implementing decision was voted on in the Standing Committee on 18 November 2015, with no opinion being delivered;

3. is van mening dat het uitvoeringsbesluit van de Commissie niet in overeenstemming is met het recht van de Unie, omdat het niet verenigbaar is met het doel van Verordening (EG) nr. 1829/2003 en Verordening (EG) nr. 396/2005, namelijk, overeenkomstig de algemene beginselen die in Verordening (EG) nr. 178/2002 zijn vastgesteld, de basis leggen voor het waarborgen van een hoog beschermingsniveau voor het leven en de gezondheid van de mens, de gezondheid en het welzijn van dieren, het milieu en de belangen van de consument met betrekking tot genetisch gemodificeerde levensmiddelen en diervoeders, waarbij de goede werking van de interne markt gewaarborgd is;
3. If, on the expiry of that period, the Council has neither adopted the proposed implementing act nor indicated its opposition to the proposal for implementing measures, the proposed implementing act shall be adopted by the Commission.
