Onverminderd de nationale wetgeving inzake toegang tot documenten zorgen de lidstaten ervoor dat de in artikel 12, lid 1, bedoelde aangewezen autoriteiten en particuliere instanties geen bij hun adviseringsactiviteit verkregen persoonlijke of individuele informatie en gegevens meedelen aan andere personen dan de landbouwer die het betrokken bedrijf beheert, met uitzondering van bij hun activiteit geconstateerde onregelmatigheden of inbreuken die vallen onder een in communautair of nationaal recht vastgestelde verplichting om een overheidsorgaan te informeren, in het bijzonder in het geval van strafbare feiten.
Without prejudice to national legislation concerning public access to documents, Member States shall ensure that the designated authorities and private bodies referred to in Article 12(1) do not disclose personal or individual information and data they obtain in their advisory activity to persons other than the farmer managing the holding concerned, with the exception of any irregularity or infringement found during their activity which is covered by an obligation laid down in Community or national law to inform a public authority, in particular in the case of criminal offences.

De resultaten van de raadpleging worden door de nationale regelgevende instanties openbaar gemaakt, behalve in geval van vertrouwelijke informatie overeenkomstig het communautair en nationaal recht betreffende zakelijke vertrouwelijkheid.

Where an SPE is a Community-scale undertaking or a controlling undertaking of a Community-scale group of undertakings within the meaning of Directive 94/45/EC or of Directive 97/74/EC extending the application of that Directive to the United Kingdom, the provisions of these Directives and the provisions transposing them into national law shall not apply to them or to their subsidiaries.

Verwijzingen naar Richtlijn 94/57/EG in het communautair of nationaal recht gelden, voor zover van toepassing, als verwijzingen naar deze verordening en worden gelezen volgens de concordantietabel van bijlage II.

Een dergelijke intrekking moet de sancties die nu of in de toekomst gelden op grond van andere bepalingen van communautair of nationaal recht, onverlet laten.
