TRADUCTIONS EN CONTEXTE

De ambten waarop dit Statuut van toepassing is, zijn in twee functiegroepen ingedeeld naargelang van de aard en het niveau van de werkzaamheden waarmee zij overeenkomen, te weten de functiegroep ‚administrateurs’ (hierna ‚AD’) en de functiegroep ‚assistenten’ (hierna ‚AST’).
The posts covered by the Staff Regulations shall be classified, according to the nature and importance of the duties to which they relate, in an administrators’ function group (hereinafter “AD”) and an assistants’ function group (hereinafter “AST”).

Wat afwijkende bepalingen betreft die de benoeming van ambtenaren van de functiegroep assistenten (AST) in ambten van de functiegroep administrateurs (AD) onder de daarin voorziene bijzondere omstandigheden mogelijk beogen te maken, moeten de bepalingen van artikel 45 bis van het Statuut over de certificeringsprocedure strikt worden uitgelegd en toegepast.
The provisions of Article 45a of the Staff Regulations concerning the certification procedure, being derogating provisions designed to allow officials in the assistants function group (AST) to be appointed to posts in the administrators function group (AD) under the special conditions laid down therein, must be interpreted and applied restrictively.

Administratieve assistenten in de overgangsfase en ondersteunende medewerkers in de overgangsfase kunnen enkel overeenkomstig de in artikelen 4 en 29, lid 1, van het statuut vastgestelde procedure worden benoemd in de standaardfunctie assistent zoals gedefinieerd in afdeling A van bijlage I. Administrative Assistants in transition and Support Agents in transition may be assigned to the type of post of Assistant as defined in Annex I, Section A, only in accordance with the procedure laid down in Articles 4 and 29(1) of the Staff Regulations.

In afwijking van artikel 5, lid 6, onder a), i), van Verordening (EG) nr. 854/2004 en sectie III, hoofdstuk III, letter A, onder a), van bijlage I bij die verordening wordt slachthuispersoneel dat door de bevoegde autoriteit gemachtigd is specifieke taken van officiële assistenten uit te voeren, slechts geschoold voor de taken die zij mogen uitvoeren en hoeven zij niet hetzelfde examen als officiële assistenten afgelegd te hebben.
By way of derogation from Article 5(6)(a)(i) to Regulation (EC) No 854/2004 and Chapter III(A)(a) of Section III of Annex I to that Regulation, slaughterhouse staff authorised by the competent authority to carry out specific tasks of official auxiliaries shall be trained in the same way as official auxiliaries only with regard to the specific tasks they are authorised to perform and shall not be required to have passed the same examination as official auxiliaries.

(4) Overwegende dat alle instellingen, organen en instanties het Bureau bijgevolg uit hoofde van hun administratieve zelfstandigheid de taak moeten opdragen interne administratieve onderzoeken in te stellen die zijn gericht op de opsporing van ernstige feiten in verband met de uitoefening van werkzaamheden in dienstverband, die kunnen worden aangemerkt als een niet-nakoming van de verplichtingen van de ambtenaren en andere personeelsleden van de Gemeenschappen, zoals genoemd in de artikelen 11, 12, tweede en derde alinea, 13, 14, 16 en 17, eerste alinea, van het Statuut van de ambtenaren van de Europese Gemeenschappen en van de Regeling welke van toepassing is op de andere personeelsleden van de Europese Gemeenschappen, hierna "Statuut" genoemd, waardoor de belangen van deze Gemeenschappen worden geschaad, en die aanleiding tot tuchtrechtelijke en, eventueel, strafrechtelijke vervolgingen kan geven, of als veroorzaakt door grove schuld als bedoeld in artikel 22 van het Statuut ofwel als een niet-nakoming van overeenkomstige verplichtingen van de leden, bestuurders of personeelsleden van de instellingen, organen en instanties van de Gemeenschappen die niet aan het Statuut onderworpen zijn;
(4) Whereas, therefore, on the basis of their administrative autonomy, all the institutions, bodies and offices and agencies should entrust to the Office the task of conducting internal administrative investigations with a view to bringing to light serious situations relating to the discharge of professional duties which may constitute a failure to comply with the obligations of officials and servants of the Communities, as referred to in Articles 11, 12, second and third paragraphs, 13, 14, 16 and 17, first paragraph, of the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities (hereinafter referred to as "the Staff Regulations"), detrimental to the interests of those Communities and liable to result in disciplinary or, in appropriate cases, criminal proceedings, or serious misconduct, as referred to in Article 22 of the Staff Regulations, or a failure to comply with the analogous obligations of the members, managers or members of staff of the institutions, bodies and offices and agencies of the Communities not subject to the Staff Regulations;
