Welnu, het EHRM heeft meer dan eens en onder andere in het arrest Hristovi tegen Bulgarije van 11 oktober 2011 onderstreept : « Where the circumstances are such that the authorities are obliged to deploy masked officers to effect an arrest, the Court considers that the latter should be required to visibly display some anonymous means of identification — for example a number or letter, thus allowing for their identification and questioning in the event of challenges to the manner in which the operation was conducted » (§ 92).
Or, la Cour EDH a pu préciser à plusieurs reprises et notamment dans l'arrêt Hristovi c. F. merkt op dat artikel XX van het General Agreement of Tariffs and Trade 1994 (GATT 1994) het volgende stelt : « subject to the requirement that such measures are not applied in a manner which would constitute a means of arbitrary or unjustifiable discrimination between countries where the same conditions prevail, or a disguised restriction on international trade, nothing in this Agreement shall be construed to prevent the adoption or enforcement by any contracting party of measures; [.] (b) necessary to protect human, animal or plant life or health; [.] (d) necessary to secure compliance with laws or regulations which are not inconsistent with the provisions of this Agreement, including those relating to customs enforcement [.]; (g) relating to the conservation of exhaustible natural resources if such measures are made effective in conjunction with restrictions on domestic production or consumption; [.];
F. considérant l'article XX de l'Accord général sur les tarifs douaniers et le commerce de 1994 (le GATT de 1994) selon lequel: « [s]ous réserve que ces mesures ne soient pas appliquées de façon à constituer soit un moyen de discrimination arbitraire ou injustifiable entre les pays où les mêmes conditions existent, soit une restriction déguisée au commerce international, rien dans le présent accord ne sera interprété comme empêchant l'adoption ou l'application par toute partie contractante des mesures [.] b) nécessaires à la protection de la santé et de la vie des personnes et des animaux ou à la préservation des végétaux; [.] d) nécessaires pour assurer le respect des lois et règlements qui ne sont pas incompatibles avec les dispositions du présent accord, tels que, par exemple, les lois et règlements qui ont trait à l'application des mesures douanières [.]; g) rapportant à la conservation des ressources naturelles épuisables, si de telles mesures sont appliquées conjointement avec des restrictions à la production ou à la consommation nationales; [.] »;

Bijzonder belangrijk hierbij zijn de volgende overwegingen van de Commissie die de volgende beginselen herhaalt (nrs. 3 en 6) : « Recalls that, in accordance with article 4 of the International Covenant on Civil and Political Rights, certain rights are recognized as non derogable in any circumstances and that any measures derogating from the provisions of the Covenant must be in accordance with that article in all cases, and underlining the exceptional and temporary nature of any such derogations en Reaffirms that it is imperative that all States work to uphold and protect the dignity of individuals and their fundamental freedoms, as well as democratic practices and the rule of law, while countering terrorism (...)».
À cet égard, on relèvera tout particulièrement l'importance des considérations de la Commission qui rappelle les principes suivants (nºs 3 et 6): « Rappelle qu'en vertu de l'article 4 du Pacte international relatif aux droits civils et politiques, certains droits ne sont susceptibles de dérogation en aucune circonstance et que toute dérogation aux dispositions du Pacte doit être en conformité avec cet article dans tous les cas, et soulignant le caractère exceptionnel et provisoire d'une telle dérogation, réaffirme qu'il est indispensable que tous les États, dans la lutte antiterroriste, s'efforcent d'affirmer et de protéger la dignité des individus et leurs libertés fondamentales, ainsi que les pratiques démocratiques et la primauté du droit (...)».

De hiërarchie van de beginselen wordt hier benadrukt; welbepaalde fundamentele rechten en vrijheden zijn van nature uit onaantastbaar : « certain rights are recognized as non derogable in any circumstances and that any measures derogating from the provisions of the Covenant must be in accordance with that article in all cases, and underling the exceptional and temporary nature of any such derogations and reaffirms that it is imperative that all states work to uphold and protect the dignity of individuals and their fundamental freedoms,a s well as democratic practices and the rule of law, while countering terrorism (.)».
Cette résolution met l'accent sur la hiérarchie des principes et précise que certains droits et libertés fondamentaux sont intangibles par nature: « Rappelle que (..) certains droits ne sont susceptibles de dérogation en aucune circonstance et que toute dérogation aux dispositions du Pacte doit être en conformité avec cet article dans tous les cas, et soulignant le caractère exceptionnel et provisoire d'une telle dérogation (.); réaffirme qu'il est indispensable que tous les États, dans la lutte antiterroriste, s'efforcent d'affirmer et de protéger la dignité des individus et leurs libertés fondamentales, ainsi que les pratiques démocratiques et la primauté du droit (.)».
