(1.01) For the purposes of subsection (1), a country that becomes a Berne Convention country, a WCT country or a WTO Member after the date of the making or publication of a work is deemed to have been a Berne Convention country, a WCT country or a WTO Member, as the case may be, at that date, subject to subsection (1.02) and sections 33 to 33.2.

33.1 (1) Despite subsections 27(1), (2) and (4) and sections 27.1, 28.1 and 28.2, if a person has, before the later of the day on which this section comes into force and the day on which a country that is a treaty country but not a WCT country becomes a WCT country, incurred an expenditure or liability in connection with, or in preparation for, the doing of an act that, if that country had been a WCT country, would have infringed a right under paragraph 3(1)(j), any right or interest of that person that arises from, or in connection with, the doing of that act and that is subsisting and valuable on the later of those days is not, except as provided by an order of the Board made under subsection 78(3), prejudiced or diminished by reason only of that country having become a WCT country.

(i) any written complaint made to the Tribunal by a domestic producer of goods alleging that like or directly competitive goods that originate in a country designated in the List of Countries set out in the schedule to the Customs Tariff as a beneficiary of the General Preferential Tariff and that are being imported into Canada at the General Preferential Tariff rates of customs duty under section 33 of the Customs Tariff, or that originate in a country designated in the List of Countries set out in the schedule to the Customs Tariff as a beneficiary of the Least Developed Country Tariff and that are being imported into Canada at the Least Developed Country Tariff rates of customs duty under section 37 of the Customs Tariff, are causing or threatening injury to that producer, or

In order to avoid further difficulties and to clarify the link between Commission Regulation (EC) No 1235/2008 of 8 December 2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries (2) and Commission Regulation (EC) No 889/2008 of 5 September 2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control (3), it is necessary to recall the duties of the control authorities or control bodies of Member States as regards non-compliant products imported from third countries recognised in accordance with Article 33(2) of Regulation (EC) No 834/2007 or from third countries having control authorities or control bodies recognised in accordance with Article 33(3) of that Regulation.
Afin d’éviter d’autres difficultés et de clarifier le lien entre le règlement (CE) no 1235/2008 de la Commission du 8 décembre 2008 portant modalités d’application du règlement (CE) no 834/2007 du Conseil en ce qui concerne le régime d’importation de produits biologiques en provenance des pays tiers (2) et le règlement (CE) no 889/2008 de la Commission du 5 septembre 2008 portant modalités d’application du règlement (CE) no 834/2007 du Conseil relatif à la production biologique et à l’étiquetage des produits biologiques en ce qui concerne la production biologique, l’étiquetage et les contrôles (3), il est nécessaire de rappeler les tâches des autorités ou organismes de contrôle des États membres en ce qui concerne les produits non conformes importés des pays tiers reconnus conformément à l’article 33, paragraphe 2, du règlement (CE) no 834/2007 ou des pays tiers disposant d’autorités ou organismes de contrôle reconnus conformément à l’article 33, paragraphe 3, dudit règlement.

Without prejudice to any measures or actions to be taken in accordance with Article 30 of Regulation (EC) No 834/2007, where a control authority or control body of a Member State or a third country has a substantiated suspicion of an infringement or irregularity as regards compliance of imported organic products from third countries recognised in accordance with Article 33(2) of Regulation (EC) No 834/2007 or imported organic products controlled by control authorities or control bodies recognised in accordance with Article 33(3) of that Regulation with the requirements laid down in that Regulation, it shall take all necessary measures in accordance with Article 91(2) of Regulation (EC) No 889/2008 and shall immediately inform the control bodies, control authorities and competent authorities of the Member States concerned and of the third countries involved in the organic production of the products in question and the Commission’.

(33) Where, as regards certain plants, plant products or other objects moved out of the Union territory to third countries, no bilateral phytosanitary agreement concluded by the Union with a third country and no phytosanitary legislation of a third country applies, protection should be offered to third countries against Union quarantine pests because of their acknowledged harmful nature, except where a Union quarantine pest is officially known to be present in the third country concerned and not under official control, or where it can be reasonably assumed that that Union quarantine pest does not meet the criteria to qualify as a quarantine pest for the third country concerned.
(33) Quand, à l’égard de certains végétaux, produits végétaux ou autres objets quittant le territoire de l’Union vers un pays tiers, il n’existe pas d’accord phytosanitaire bilatéral entre l’Union et ledit pays et que le droit de ce dernier ne s’applique pas, il convient de le protéger des organismes de quarantaine de l’Union en raison de leur caractère nuisible reconnu, sauf quand la présence d’un organisme de quarantaine de l’Union est officiellement constatée dans ce pays tiers et ne fait pas l’objet d’un contrôle officiel, ou quand il peut être raisonnablement établi que cet organisme ne répond pas aux critères permettant de le qualifier d’organisme de quarantaine dans ce pays.

In accordance with Article 33(2) of Regulation (EC) No 834/2007, Annex III to Commission Regulation (EC) No 1235/2008 of 8 December 2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries (2) has established a list of third countries whose system of production and control measures for organic production of agricultural products are recognised as equivalent to those laid down in that Regulation.

detailed rules as regards the rules on imports from third countries laid down in Title VI, in particular as regards the criteria and procedures to be followed with regard to the recognition under Article 32 and 33 of third countries and control bodies, including the publication of lists of recognised third countries and control bodies, and as regards the certificate referred to in Article 33(1) point (d) taking into account the advantages of electronic certification;
