IN-CONTEXT TRANSLATIONS

(2) The Bank shall, in accordance with these Regulations, register bonds, discharge the registration of bonds and give effect to transfers of bonds as may be required from time to time and may, subject to the terms upon which the bonds are issued, issue such bonds as may be required for these purposes or to give effect to the terms of outstanding bonds or these Regulations.
(2) La Banque accomplira, conformément au présent règlement, les immatriculations, radiations d’immatriculation et inscriptions de transferts d’obligations qui seront éventuellement requis et pourra, sous réserve des modalités de l’émission, émettre toutes obligations qu’il y aura lieu à ces fins ou pour donner suite aux termes d’obligations en circulation ou du présent règlement.

58 (1) Goods, other than cigars and manufactured tobacco, warehoused under this Act may, without payment of duty, be transferred or removed from one bonding warehouse to another in bond, exported in bond or released from bond to accredited representatives for their personal or official use, if the transfer, removal, exportation or release is in accordance with the regulations and the ministerial regulations.
58 (1) Les marchandises, sauf le tabac fabriqué et les cigares, entreposées sous le régime de la présente loi peuvent, en franchise de droits, être transférées d’un entrepôt à un autre en douane, être exportées en douane ou être dédouanées en faveur de représentants accrédités pour leur usage personnel ou officiel si le transfert, l’exportation ou le dédouanement s’effectue conformément aux règlements et aux règlements ministériels.

(2) Where in error a bond is issued or registered in circumstances in which such issue or registration is not authorized by these Regulations and the bond has been delivered, the person receiving the bond or registered as owner thereof shall not be entitled as against the Government of Canada to any payment under the bond but shall be liable to return the bond and all coupons attached to it at the time it was delivered to him and if he fails to do so he shall be liable to pay to the Bank the market value of the bond together with an amount equal to any amounts paid to him by way of interest on the bond.
(2) Lorsque, par erreur, une obligation est émise ou immatriculée dans des circonstances où le présent règlement ne l’autorise pas, et que l’obligation a été livrée, la personne qui la reçoit ou qui en est immatriculée comme titulaire n’aura, vis-à-vis du gouvernement du Canada, droit à aucun paiement relatif à l’obligation, mais sera tenue de retourner celle-ci avec tous les coupons dont elle était munie lorsqu’elle lui a été livrée et, à défaut, de payer à la Banque le prix courant de l’obligation ainsi qu’une somme égale à toutes sommes à elle payées à titre d’intérêt de l’obligation.

(2) Where a bond is in the possession of Her Majesty or the Bank and the owner of the bond cannot be located, or Her Majesty or the Bank had been requested to retain the bond in safekeeping, the bond may, notwithstanding anything in these Regulations, be treated, on the date of maturity, as though it had been redeemed, and a liability shall be set up in the books of the Department of Finance, in the amount of the bond and any interest that accumulated thereon to the date of maturity,

(50) To avoid institutions structuring their liabilities in a manner that impedes the effectiveness of the bail in tool it is appropriate to establish that the institutions should have at all times an aggregate amount of own funds, subordinated debt and senior liabilities subject to the bail in tool expressed as a percentage of the total liabilities of the institution, that do not qualify as own funds for the purposes of Directive 2006/48/EC or Directive 2006/49/EC and excluding bonds as referred to in Article 52(4) of Directive 2009/65/EEC of the European Parliament and o the Council of 13 July 2009 on the coordination of laws, regulations and aministrative provisions relating to undertakings for collective investment in transferable securities (UCITS) (covered bonds).
(50) Pour éviter que les établissements ne structurent leur passif d'une manière qui limite l'efficacité de l'instrument de renflouement interne, il convient de leur imposer de détenir en permanence un montant agrégé, exprimé en pourcentage de leur passif total, de fonds propres, de créances subordonnées et de créances de rang supérieur qui ne constituent pas des fonds propres aux fins de la directive 2006/48/CE ou de la directive 2006/49/CE, et à l'exception des obligations visées à l'article 52, paragraphe 4, de la directive 2009/65/CE du Parlement européen et du Conseil du 13 juillet 2009 portant coordination des dispositions législatives, réglementaires et administratives concernant certains organismes de placement collectif en valeurs mobilières (OPCVM) (obligations couvertes).

(10) The Union support provided by means of this Regulation should mitigate the risk inherent in project bonds to the extent that capital market participants are willing to invest in a larger volume infrastructure project bonds than would be possible without Union support.
