(2) Notwithstanding subsection (1), any person described in paragraph 26(m) of the Act to whom a pension under Part II or III of the former Act is payable may, within one year of becoming a contributor under Part I of the Act, elect to surrender the original pension, whereupon the contributor shall be deemed, for the purposes of the Act, to be a person by whom an election under subsection 18(2) of the Royal Canadian Mounted Police Superannuation Act, c. R-11 of the Revised Statutes of Canada, 1970 was made at the time of the surrender of the original pension, in all respects as though the contributor were a person described in subsection 18(2) of the Royal Canadian Mounted Police Superannuation Act, c. R-11 of the Revised Statutes of Canada, 1970, except that if, upon subsequently ceasing to be a member of the Force, the contributor is entitled under Part I of the Act to an annuity or annual allowance the capitalized value of which is less than the capitalized value of the original pension, in lieu of any other benefit under Part I of the Act whatever right or claim that, but for this subsection, the contributor would have had to the original pension upon subsequently ceasing to be a member of the Force shall thereupon be restored to the contributor, and there shall be paid to the contributor an amount equal to his contributions under Part I of the Act made in respect of his augmenting service.

(2) If, on subsequently ceasing to be a member of the regular force, a contributor referred to in subsection (1) is entitled to an annuity or annual allowance under this Part the capitalized value of which is less than the capitalized value of the original annuity, the contributor shall be entitled to benefits prescribed in regulations made under subsection (3) in place of any other benefit under this Part and Part III to which they would otherwise be entitled, but in no case shall the capitalized value of the benefits be less than the capitalized value of the original annuity.

(b) if at any time at or before a specified time in a trust’s taxation year, a resident contributor to the trust contributes to the trust property that is restricted property of the trust, or property for which restricted property of the trust is substituted, and the trust is at that specified time an exempt foreign trust by reason of paragraph (f) of the definition “exempt foreign trust” in subsection (1), the amount of the trust’s income for the taxation year from the restricted property, and the amount of any taxable capital gain from the disposition in the taxation year by the trust of the restricted property, shall be included in computing the income of the resident contributor for its taxation year in which that taxation year of the trust ends and not in computing the income of the trust for that taxation year of the trust; and

(c) where an annuity or annual allowance to which a recipient is entitled under Part I of the Act in respect of any augmenting service of a person is an annuity or annual allowance the monthly instalments of which would amount to less than $10 each, there may be paid to the recipient upon request by the contributor in writing to the Minister within three months from the time the contributor became so entitled, a lump sum payment equal to the capitalized value of the annuity or annual allowance computed in accordance with the basis set out in the a(f) and a(m) Ultimate Tables together with interest at the rate of four per cent per annum, which lump sum payment shall be in lieu of any other benefit under Part I of the Act in respect of that augmenting service.

Points out that SMEs, which form the keystone of Europe's economy, are particularly hard-hit by the current economic downturn; stresses that the credit squeeze has hit the SME sector hardest, since it is the part of the economy that relies most on short-term working capital, usually provided through credits; points out that lack of capital, coupled with a generalised slump in demand is forcing SMEs to retreat on all fronts; points out that the current hardships of SMEs, as the largest contributors to GDP and the largest employer in the EU, are having far-reaching consequences for the EU as a whole and in particular for the most vulnerable and affected regions; underlines, furthermore, the importance of rapidly implementing the Small Business Act in general and especially provisions for credits to SMEs through EIB action;

Fourthly, how can you guarantee that the greater involvement by pension funds in risk capital called for in the report may not lead to pension contributions being lost, which would run counter to the contributors' objective of ensuring a secure retirement?
