TRADUCTIONS EN CONTEXTE

On Flag State requirements, Portugal has failed to comply with its obligations to develop, implement and maintain a quality management system for the operational parts of the flag State-related activities of its administration, which is to be certified in accordance with the applicable international quality standards (Article 8(1) of Directive 2009/21/EC).

First, paragraph 16.1 of part 2 of the III Code provides for a minimum list of resources and processes which flag States have to establish, including the provision of administrative instructions pertaining, inter alia, to ship class certificates required by the flag State to demonstrate compliance with structural, mechanical, electrical, and/or other requirements of an international convention to which the flag State is a party or compliance with a requirement of the flag State's national regulation.

In the event that the inspections referred to in Article 5(2) and Article 7 give rise to detention, the competent authority shall immediately inform, in writing and including the report of inspection, the administration of the State whose flag the ship is entitled to fly (hereinafter called 'flag administration') or, when this is not possible, the Consul or, in his absence, the nearest diplomatic representative of that State, of all the circumstances in which intervention was deemed necessary.
