– having regard to Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities ,
– vu le règlement (CE, Euratom) nº 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) nº 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes ,

1. In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (1) and the Financial Regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) and with the other instruments referred to in this Decision, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

Conformément au règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (1) et au règlement financier adopté par le conseil d'administration de l'Agence le 26 mars 2003, au règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (2), ainsi qu'aux autres réglementations auxquelles se réfère la présente décision, les contrats ou conventions conclus ainsi que les décisions prises avec des bénéficiaires établis en Suisse peuvent prévoir que des audits scientifiques, financiers, technologiques ou autres peuvent être effectués à tout moment auprès d'eux et de leurs sous-traitants par des agents de l'Agence et de la Commission ou par d'autres personnes mandatées par celles-ci.

Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 (13) (hereinafter referred to as the ‘Framework Financial Regulation’) should apply to the Foundation.
Il convient que le règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil (13) (ci-après dénommé «le règlement financier cadre») soit applicable à la Fondation.

The Joint Undertaking should have, subject to prior consultation with the Commission, its own financial regulation based on the principles of Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the Framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (11) (the Framework Financial Regulation) taking into account its specific operating needs arising, in particular, from its international obligations.
L'entreprise commune devrait faire l'objet, sous réserve d'une consultation préalable de la Commission d'un règlement financier propre fondé sur les principes du règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (11) (ci-après dénommé «règlement financier-cadre») et tenant compte de ses besoins opérationnels spécifiques découlant notamment de ses obligations internationales.

15. Expects the Agencies to complete their procedures for bringing into line their internal financial rules with the requirements of the new framework Financial Regulation as soon as possible and in any event by the end of the year at the latest; recalls that such internal financial rules may not depart from the framework Financial Regulation except where the specific operating needs of an Agency so require and with the Commission's prior consent; calls on the Agencies once they have completed such process to inform Parliament's competent Committees; asks the Court of Auditors to give an opinion on all financial provisions adopted by the Agencies which depart from the framework Financial Regulation;
15. attend des agences qu'elles mènent à bien les procédures d'alignement de leurs dispositions financières internes sur celles du nouveau règlement financier dans les meilleurs délais et en tout cas avant la fin de l'année en cours; rappelle que les règles internes ne peuvent s'écarter du règlement financier à moins que les exigences de fonctionnement propres à une agence ne le nécessitent et que la Commission n'ait donné son accord préalable; invite les agences, une fois qu'elles auront mené à bien ce processus, à en informer les commissions compétentes du Parlement; invite la Cour des comptes à émettre un avis sur toutes les dispositions financières adoptées par les agences qui s'écartent du règlement financier;

They may not depart from Commission framework Financial Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities(9) unless specifically required for the Foundation's operation and with the Commission's prior consent.
Elle ne peut s'écarter du règlement (CE, Euratom) n° 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) n° 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes(9) que si les exigences spécifiques du fonctionnement de la Fondation le nécessitent et avec l'accord préalable de la Commission.
