The main points are set forth below: The Commission proposal for a Council Directive on the approximation of the laws of the Member States relating to certain employment relationships with regard to distortions of competition (based on Article 100 of the Treaty) provides : - that part-time and temporary workers should enjoy access to vocational training operations and social services provided by the firm under conditions comparable to those enjoyed by workers employed fulltime for an indefinite duration; they should also enjoy the same treatment as regards benefits in cash and in kind granted under social assistance schemes or under non-contributory social security schemes; - such employees should also be taken into account, on the same footing as the other employees (and in proportion to the duration of their work) for the calculation of the threshhold within the undertaking at which workers' representative bodies must be set up. Where the employer intends to use such employees, he is required to inform (and consult) in due time the workers' representative bodies within the undertaking, and in undertakings with more than 1 000 employees a regular report must be drawn up on this type of employment with regard to the development of the workforce as a whole. In the same vein, the employer is required in due time to inform part-time and temporary workers currently in employment when he proposes to recruit full-time workers for an indefinite duration, so that their applications can be given due consideration; ./.
Il importe ici d'en rappeler l'essentiel : La proposition de Directive du Conseil concernant le rapprochement des dispositions des Etats membres relatives à certaines relations de travail au regard des conditions de travail (basée sur l'Article 100 du Traité) prévoit que : - les travailleurs à temps partiel ainsi que les travailleurs temporaires doivent bénéficier, dans des conditions comparables à celles des travailleurs à temps plein et à durée indéterminée, de conditions comparables en ce qui concerne l'accès à la formation professionnelle et aux services sociaux de l'entreprise ainsi que des prestations en nature ou en espères versées au titre d'un régime d'assistance sociale ou au titre d'un régime de sécurité sociale non contributive/. - 5 - - ces mêmes travailleurs doivent être pris en compte, au même titre que les autres salariés -et proportionnellement à la durée de leurs prestations- pour le calcul des seuils au-delà desquels la constitution des instances représentatives des travailleurs au sein de l'entreprise est requise. Au reste, lorsque l'employeur envisage de faire recours à de tels travailleurs, il est tenu d'informer (et de consulter) à temps utile les instances représentatives existantes et, dans les entreprises de plus de 1000 salariés, un relevé périodique de ce type d'emplois sera établi au regard de l'évolution de l'ensemble des effectifs. Dans le même esprit, l'employeur est tenu d'informer en temps utile les travailleurs à temps partiel et temporaires déjà en place lorsqu'il envisage de recruter des travailleurs à temps plein pour une durée indéterminée, de façon à ce que leur candidature éventuelle puisse être considérée.
