There has been some progress in some very specific areas, for example the adoption of a Code of Conduct on documenting transfer pricing[2] and Guidelines for Advanced Pricing Agreements in the EU[3], and the Commission issued three Communications in December 2006[4] on the need for increased coordination between Member States as regards their tax systems and one on tax incentives in favour of research and development[5].

4. This third Communication therefore has as its main objective to prevent transfer pricing disputes and associated double taxation from arising in the first place by introducing Guidelines for Advance Pricing Agreements (hereafter: "APAs") within the EU.

Future work will focus on documentation requirements and on possible preventative measures to avoid double taxation in the area of transfer pricing (e.g. Advance Pricing Agreements).
