Notes the Court of Auditors’ finding that in 2008 Eurojust still had a problem as regards carrying forward appropriations, even if it seems that the amount was lower than in the previous year (13% of final budget appropriations, instead of the 25% of appropriations carried over in 2007); notes with concern, however, that the level of appropriations carried over from the previous year and then cancelled (EUR 1 000 000, or 25% of appropriations carried over) was high and that this situation is at odds with the annuality principle; calls therefore on Eurojust to take action to prevent this situation from recurring in future and then inform to the discharge authority;

After listening to her testimony, questioning her and having a thorough discussion in the committee, we determined in regard to the proposal she was making, although it was in its essence very valid, that is, concerns over privacy and how information was being used or could be used and in fact abused, it was not appropriate to deal with it at this time in this bill (1650) I think we all felt we had a sense of responsibility to the Privacy Commissioner to be very clear with her that we appreciated her initiative in this regard and that it is one she should pursue in other legislation, either in existing law or in fact some amendments to new legislation that should be forthcoming in the next while.

In order to obtain a true pricture of the increases, it must be borne in mind that the 1988 budget takes into account the fact that in several sectors (principally research, IMPs, youth exchange and development), the appropriations actually available in 1988 include carryovers which are often quite considerable. There will be virtually no such carry-overs in 1989 following the strengthening of the principle of annuality as a result of the current revision of the Financial Regulation, which will make it practically impossible to carry over appropriations from one year to the next with effect from 1 January 1989.

The EU has taken a leading role in the negotiation, notably by establishing the principle that of the commitments China would make when joining the WTO, most would be implemented on the date of membership, but some could be implemented under multilateral surveillance over a specified period after entry into the WTO. This reflects a sympathetic understanding of the fact that China is rapidly developing, but in important respects has not yet assumed all the characteristics of a fully-fledged market economy. The EU stands by this principle, and urges further political commitment from all partners in order to reach a deal. For WTO membership to happen, the EU will be urging China to take basic steps that bring it sufficiently into line with internationally agreed rules, notably by: reducing tariffs to a weighted average no more than twice the OECD average; opening up its market in traded services; liberalising the foreign trade monopoly, if necessary over a phase-in period; adhering to multilateral rules on aviation and on public procurement; phasing out all quotas and non-tariff barriers that breach WTO rules; making China's industrial policies WTO-compatible; accepting appropriate provisions on subsidies, standards, state-pricing, state-trading and the elimination of export duties; and defining an appropriate trade defence mechanism for use during the transition period.
