– (CS) Mr President, here on the floor of the European Parliament, I would like to draw your attention to judgment C-236/09 of the European Court of Justice of last week.

Lastly, both the Commission in the contested decision and the General Court in the judgment under appeal misinterpreted the appellant’s intentions, attributing to it the aim of contriving to render a decision which referred to a general scheme one that concerned it individually and, as a result of that misunderstanding, incorrectly failed to consider the impact which the factors brought to their attention by the appellant could have had on the assessment of the scope of the aid scheme in general terms.

The Commission draws attention to the judgment given on 30 April 1996 in the "CIA Security" case (C-194/94 - ECR I, p. 2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before the national court which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.

Lastly, the Commission draws attention to two matters to be dealt with in future: the amendment of the legal basis of the Framework Decision following the judgment in Case C-176/03 (see above), and the review of Article 2 of the Council Framework Decision before 21 July 2010 with regard to renewing the declarations by Member States.
Enfin, la Commission attire l'attention sur deux questions à traiter dans l'avenir : la modification de la base juridique de la décision-cadre suite à l'arrêt C-176/03 (voir ci-dessus) et le réexamen de l'article 2 de la décision-cadre par le Conseil avant le 21 juillet 2010 en ce qui concerne le renouvellement des déclarations des États membres.
