This Regulation should cover public documents issued by the authorities of a Member State, in accordance with its national law, and the primary purpose of which is to establish one of the following facts: birth, that a person is alive, death, name, marriage (including capacity to marry and marital status), divorce, legal separation or marriage annulment, registered partnership (including capacity to enter into a registered partnership and registered partnership status), dissolution of a registered partnership, legal separation or annulment of a registered partnership, parenthood, adoption, domicile and/or residence, or nationality.

The aim of this Regulation is not to change the substantive law of the Member States relating to birth, a person being alive, death, name, marriage (including capacity to marry and marital status), divorce, legal separation or marriage annulment, registered partnership (including capacity to enter into a registered partnership and registered partnership status), dissolution of a registered partnership, legal separation or annulment of a registered partnership, parenthood, adoption, domicile and/or residence, nationality, the absence of a criminal record, or to public documents the presentation of which can be required by a Member State from a candidate in elections to the European Parliament or in municipal elections or from a voter in such elections who is a national of that Member State.

This Regulation also establishes multilingual standard forms to be used as a translation aid attached to public documents concerning birth, a person being alive, death, marriage (including capacity to marry and marital status), registered partnership (including capacity to enter into a registered partnership and registered partnership status), domicile and/or residence and absence of a criminal record.

In order to overcome language barriers and thereby further facilitate the circulation of public documents between the Member States, multilingual standard forms should be established in each of the official languages of the institutions of the Union for public documents concerning birth, a person being alive, death, marriage (including capacity to marry and marital status), registered partnership (including capacity to enter into a registered partnership and registered partnership status), domicile and/or residence, and absence of a criminal record.

3. Stresses the importance of strengthening the political, economic and social rights of women, especially in the context of family law (for example, with regard to marriage, divorce, child custody, parental rights, nationality, heritage, legal capacity, etc.), in compliance with international instruments;

Calls on the authorities of the countries concerned irreversibly to enshrine in their constitutions the principle of equality between men and women in order to state explicitly the prohibition of all forms of discrimination and violence against women and girls, the possibility of affirmative actions and the entrenchment of women’s political, economic and social rights; calls on lawmakers in those countries to reform all existing laws and to incorporate the principle of equality into all projects or legislative proposals that could lead to discrimination against women, for example in the area of marriage, divorce, child custody, parental rights, nationality, inheritance and legal capacity, in line with international and regional instruments, and to entrench the existence of domestic mechanisms for the protection of women’s rights;

The regulation will apply only to the dissolution of the marriage or cessation of marital obligations (legal separation) and will not apply to matters relating to the legal capacity of natural persons, the existence, validity or recognition of a marriage, the annulment of a marriage, the name of the spouses, the property consequences of the marriage, parental responsibility, maintenance obligations, trusts or successions, even if they arise merely as a preliminary question within the context of divorce or legal separation proceedings.

Preliminary questions on issues such as legal capacity and the validity of a marriage, and on matters such as the effects of divorce or legal separation on property, name, parental responsibility, maintenance obligations or any other ancillary measures, should be determined by the conflict-of-law rules applicable in the participating Member State concerned.
Les questions préalables sur des points telles que la capacité juridique et la validité du mariage, et sur des sujets tels que les effets patrimoniaux du divorce ou de la séparation de corps, le nom, la responsabilité parentale, les obligations alimentaires ou toutes autres mesures accessoires, devraient être déterminées par les règles de conflit de lois applicables dans l'État membre participant concerné.
