Regardless of its form, Community financial assistance should be granted in accordance with the provisions of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (the Financial Regulation) and of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities , except where the provisions of this Regulation explicitly depart from those rules.

When actions financed under this Regulation are implemented, the financial interests of the Community should be protected by the application of preventive measures against fraud, corruption and any other illegal activities, by effective checks and by the recovery of amounts unduly paid and, if irregularities are detected, by effective, proportionate and dissuasive penalties, in accordance with Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities financial interests , Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities and with Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF)

Community financial engineering must take account of a number of aspects : the concern of the national authorities to limit their budget commitments; the constraints on the Community budget; the relative abundance of private capital available; the need to improve the channels through which European savings flow to the market; and the need for cohesion, which has become even greater following enlargement and means that the Community must overhaul its operating methods and instruments for structural action.
L'ingenierie financiere communautaire doit repondre a plusieurs considerations : le souci des autorites nationales de limiter leurs engagements budgetaires; les contraintes qui pesent sur le budget communautaire; l'abondance relative des capitaux prives disponibles; la necessite d'ameliorer les canaux par lesquels transite l'epargne europeenne; enfin l'exigence de cohesion, qui est devenue plus forte encore apres l'elargissement, et qui impose a la Communaute de renouveler ses methodes et outils d'intervention dans le domaine structurel.

With a view to making all practitioners in the field of Community financial law aware of that need, the Directorate-General for Financial Control and the Legal Service of the Commission of the European Communities are organizing in Brussels from 27 to 29 November a seminar on: "The legal protection of the Community's financial interests" The seminar, which is to be held under the auspices of Mr Peter Schmidhuber, Member of the Commission responsible for financial control, will be addressed by speakers from the Community institutions, national administrations and political, legal and scientific circles.
