Mr. John Bryden (Wentworth—Burlington, Lib.): Madam Speaker, as we approach the end of the millennium and the beginning of the next, there is one novel aspect of this legislation I would like the hon. member to comment on, especially since he is very well known in Canada as an expert in many aspects of the law, constitutional law among them. It is the fact that possibly for the first time we are making the provision for applying the criminal code and other statutes out of this world.

To say in the House of Commons, in this very parliament, that constitutional law and the constitution are nothing, when in the mind of members of the Bloc Quebecois the constitution is the basic law which governs the relationship among provinces and among private citizens, is to show contempt to a degree that would not have been thought possible on the part of today's politicians.

– to fully restore the prerogatives of the Constitutional Court as the supreme body of constitutional protection, and thus the primacy of the Fundamental Law, by removing from its text the limitations on the Constitutional Court’s power to review the constitutionality of any changes to the Fundamental Law, as well as the abolition of two decades of constitutional case law; to restore the right of the Constitutional Court to review all legislation without exception, with a view to counterbalancing parliamentary and executive actions and ensuring full judicial review; such a judicial and constitutional review may be exerted in different ways in different Member States, depending on the specificities of each national constitutional history, but once established, a Constitutional Court – like the Hungarian one, which after the fall of the communist regime has rapidly built a reputation among Supreme Courts in Europe – should not be subject to measures aimed at reducing its competences and thus undermining the rule of law;

X. whereas the history of democratic traditions in Europe shows that reforming a constitution requires the utmost care and due consideration of procedures and guarantees aimed at preserving, among other things, the rule of law, the separation of powers and the hierarchy of legal norms – the constitution being the supreme law of the land;

The second interpretive approach, which was raised in the course of the Committee’s proceedings but found little support among the constitutional law experts, holds that in addition to the four matters where the Constitution specifically requires provincial agreement, there is a further restraint on Parliament’s power to amend the Constitution in relation to the Senate. Parliament cannot act on its own if an amendment would affect the “fundamental features, or essential characteristics” of the Senate.
