As regards the damage resulting from the loss sustained, namely the charges and expenses incurred by the applicant in connection with its participation in the tendering procedure, it should be noted, first, that under Article 23(1) of the General Regulations, the contracting authority may, prior to awarding the contract, without thereby incurring any liability to the tenderers, and regardless of the stage reached in the procedures leading to the conclusion of the contract, either decide to close or annul the tendering procedure in accordance with paragraph 2, or order that the procedure be recommenced, if necessary, on amended terms.
